based on earnings in employment which terminated on or before
May 31, 1964, and all benefits chargeable to an experience-rating
record of an employer who discontinued his business within the 12-
consecutive-calendar-month period ending on the computation date.

Provided, that under no circumstances shall any employer be re-
quired to pay contributions at a rate, including the adjustment per-
centage provided in [subsection (c) (4) (i) of this section] this sub-
section (c) (4),
of more than 4.2 percent.

Provided further that, for the purpose of making any computation
under this subsection, any amount which has been credited to Mary-
land's account under Section 903 of the Social Security Act, as
amended, and which has been appropriated for expenses of adminis-
tration, whether or not withdrawn from said account, shall be ex-
cluded from the total amount available for benefits in the fund.

Sec. 2. And be it further enacted, That this Act shall take effect
June 1, 1965.

CHAPTER 45
(Senate Bill 51)

AN ACT to repeal and re-enact, with amendments, Section 4 of
Article 78D of the Annotated Code of Maryland (1964 Supple-
ment), title "Regional Planning Council", sub-title "Establishment
and Organization", amending the laws concerning membership in
the Regional Planning Council in order to correct errors therein.

Section 1. Be it enacted by the General Assembly of Maryland,
That Section 4 of Article 78D of the Annotated Code of Maryland
(1964 Supplement), title "Regional Planning Council", sub-title "Es-
tablishment and Organization", be and it is hereby repealed and re-
enacted, with amendments, to read as follows:

The membership of The Council shall include two representatives
from the City of Baltimore, two representatives from each of the
counties of Anne Arundel, Baltimore, Carroll, Harford, and Howard,
the Director of the State Department of Planning, the Chairman-
Director of the State Roads Commission, a member of the Metropoli-
tan Transit Authority, a member of the Maryland Port Authority
and four representatives to be appointed by the Governor, respec-
tively to be appointed as follows:

The Mayor of the City of Baltimore, with the approval of the city
council, shall appoint one member of the city council of Baltimore
as a member of The Council; and the Mayor of the City of Baltimore
shall appoint one appointed member of the Baltimore City planning
commission as a member of The Council. The county executive of
Baltimore County, with the approval of the County Council, shall
appoint one member of the County Council of Baltimore County as a
