THE COUNTY COMMISSIONERS MAY OPERATE AND
MAINTAIN A TRACT OF LAND OR TRACTS OR PARCELS OF
LAND FOR THE DISPOSAL OF REFUSE, GARBAGE, RUBBISH,
OR ANY OTHER MATTER AS IN THEIR JUDGMENT MAY
PROMOTE THE PUBLIC HEALTH OF THE INHABITANTS OF
THE COUNTY. THE COUNTY COMMISSIONERS, SO FAR AS
POSSIBLE, SHALL INSTITUTE, MAINTAIN, AND OPERATE
SUCH FACILITIES IN SUCH A MANNER AS TO BE SELF-
SUPPORTING FROM FEES AND SERVICE CHARGES COL-
LECTED FOR USE OF SAID FACILITIES. IN THE EXERCISE
OF THIS POWER, THE COUNTY COMMISSIONERS MAY:
(1) PRESCRIBE AND ENFORCE RULES AND REGULA-
TIONS CONCERNING THE OPERATION AND MANNER OF
USE OF THE DISPOSAL FACILITIES OR AREAS;
(2) FIX AND COLLECT A REASONABLE SERVICE
CHARGE FROM ANY PERSON, FIRM, CORPORATION, MUNIC-
IPAL CORPORATION, SPECIAL DISTRICT OR OTHER COUNTY
FOR THE USE OF SAID FACILITIES OR AREAS; AND TO
PAY SUCH PERSONNEL AS MAY BE FOUND NECESSARY
OR DESIREABLE FOR THE OPERATION, SUPERVISION OR
MANAGEMENT OF SAID FACILITIES OR AREAS;
(3) MAKE AGREEMENTS WITH PERSONS, FIRMS, COR-
PORATIONS, MUNICIPAL CORPORATIONS, SPECIAL DIS-
TRICTS, OR OTHER COUNTIES FOR COOPERATION IN, AND
rubbish, or any other matter as in their judgment may promote the
public health of the inhabitants of the county. The County Com-
missioners, so far as possible, shall institute, maintain, and operate
this system in such a manner as to be self-supporting from the fees
and service charges collected for use of the system. In the exercise of
this power, the County Commissioners may:
(1) prescribe and enforce rules and regulations concerning the
operation of the collection, removal, and disposal system;
(2) fix and collect a reasonable service charge from any person,
firm, corporation, municipal corporation, special district, or other
county for the use of the collection, removal, and disposal system;
(3) issue permits to persons, firms, and corporations engaged in
the collection and removal of refuse, garbage, and rubbish and issue
permits for the use of the disposal system;
(4) make agreements with municipalities, special districts, or
other counties for cooperation in the performance of the collection,
removal, and disposal system; and
(5) acquire land as need for the purposes of this section, by
purchase, gift, or condemnation.
In order to institute the collection, removal, and disposal system,
the County Commissioners may appropriate monies from the general
funds of Allegany County, provided that the monies appropriated be
paid back to the general fund from the fees and service charges
collected for the use of such collection, removal, and disposal system;
and after this reimbursement, the fees and service charges shall be
applied to the maintenance, operation, or expansion of the system.
