EVENT OF CERTAIN ACTION BY THE POTOMAC RIVER
FISHERIES COMMISSION OR FOR OTHER REASONS.

Section 1. Be it enacted by the General Assembly of Maryland,
That new Sections 713(f), 714(f-l), 715A(h), 715B(g-l) and
715C(f-l) be and they are hereby added to Article 66C of the Anno-
tated Code of Maryland (1957 Edition and 1964 Supplement), title
"Natural Resources," subtitle "Oysters and Clams," to follow im-
mediately after Sections 713(e), 714(f), 715A(g), 715B(g) and
715C(f) thereof, Section 714 thereof having been last amended by
Chapter 694 of the Acts of 1963, and all to read as follows:

713(f).

714(f-l).

715A(h).

715B(g-1).

715C(f-1).

(a) It is unlawful for any person who is licensed in the State to take
or catch soft-shell clams and for any boat or rig licensed in the State
for or used in the taking or catching of soft-shell clams to take or
catch more than forty (40) bushels of soft-shell clams in any calendar
day. The provisions of this section and of the other applicable sections
of this subtitle shall be effective as to any clams landed in the State
regardless of where the clams were taken or caught.

(B)  WHENEVER THE POTOMAC RIVER FISHERIES COM-
MISSION UNDER ITS REGULATORY POWERS ESTABLISHES
A DAILY CATCH LIMITATION DIFFERENT FROM THAT SET
IN THIS SECTION OR WHENEVER IN THE JUDGMENT OF
THE DEPARTMENT THE INTEREST OF CONSERVATION OR
THE CLAMMING INDUSTRY OR BOTH SO REQUIRE, THE DE-
PARTMENT IS AUTHORIZED BY REGULATION TO CHANGE
THE DAILY LIMITATION PROVIDED HEREIN TO THE DAILY
FIGURE ESTABLISHED BY THE POTOMAC RIVER FISH-
ERIES COMMISSION.

(C)   THE LIMITATION IMPOSED UNDER THIS SECTION
IS APPLICABLE TO ALL CLAMS CAUGHT OR TAKEN WITHIN
THE GEOGRAPHICAL LIMITS OF THE STATE OF MARYLAND.

SEC. 2. And be it further enacted, That this Act shall take effect

June 1, 1965.

SEC. 2. AND BE IT FURTHER ENACTED, THAT THIS ACT
IS HEREBY DECLARED TO BE AN EMERGENCY MEASURE
AND NECESSARY FOR THE IMMEDIATE PRESERVATION
OF THE PUBLIC HEALTH AND SAFETY, AND HAVING BEEN
PASSED BY A YEA AND NAY VOTE SUPPORTED BY THREE-
FIFTHS OF THE MEMBERS ELECTED TO EACH OF THE TWO
HOUSES OF THE GENERAL ASSEMBLY, THE SAME SHALL
TAKE EFFECT FROM THE DATE OF ITS PASSAGE.
