PEAKE BAY AFFAIRS has planted or shall have planted oysters
or shells. Upon the completion of a resurvey of any submerged area
of the waters of the State to determine the positions and extent of
natural oyster bars, such completed resurvey, as far as the classifica-
tion of bottoms is concerned, shall supersede the Oyster Survey of
1906 to 1912 or any decision of any circuit court rendered prior to
the completed resurvey as to the area resurveyed. No natural oyster
or clam bar,
AS may be defined in this article, shall ever be leased
whether represented on the Oyster Survey of 1906-1912 chart or upon
location or relocation under any resurvey subsequent thereto.

A natural oyster bar shall also be construed to mean and include
all oyster beds and bars under any of the waters of this State
whereon the natural growth of oysters is of such abundance that
the public have resorted to such beds or bars for a livelihood, whether
continuously or at intervals, during any oyster season within five
years prior to the filing of any application for a lease of the area
in question, or within five years prior to the making of a resurvey
under Section 70S, provided that the actual condition of the area in
question at any time within said respective five-year periods shall
be taken into consideration in determining whether or not said area
is a natural oyster bar.

SEC. 2. AND BE IT FURTHER ENACTED, THAT NOTHING
IN THIS ACT APPLIES TO OR AFFECTS ANY OTHER LAW
OR PART OF LAW NOT SPECIFICALLY REFERRED TO
HEREIN.

Sec. 2. 3. And be it further enacted, That this Act is hereby de-
clared to be an emergency measure and necessary for the immediate
preservation of the public health and safety, and having been passed
by a yea and nay vote supported by three-fifths of the members elected
to each of the two Houses of the General Assembly, the same shall
take effect from the date of its passage.

CHAPTER 181
(House Bill 35)

AN ACT to add new Sections 713(f), 714(f-l), 715A(h), 715B(g-l)
and 715C(f-l) to Article 66C of the Annotated Code of Maryland
(1957 Edition and 1964 Supplement), title "Natural Resources,"
subtitle "Oysters and Clams," to follow immediately after Sections
713(e), 714(f), 715A(g), 715B(g) and 715C(f), Section 714
thereof having been last amended by Chapter 694 of the Acts of
1963, to prohibit persons licensed to take or catch soft-shell clams
in the State from taking or catching more than a certain quantity
of such clams on a daily basis, and to subject clams landed in the
State, regardless of where caught or taken, to the provisions of this
and any other applicable section of the clam laws AND TO
CHANGE THE DAILY CATCH LIMITS HEREUNDER IN THE
