CHAPTER 917
(House Bill 36)

AN ACT to repeal and re-enact, with amendments, Section 708 (w)

of Article 66C of the Annotated Code of Maryland (1957 Edition),
title "Natural Resources," subtitle "Oysters and Clams," to change

the season for taking or catching oysters for sale from leased

areas in St. Mary's County, CHARLES, CALVERT, ANNE
ARUNDEL, TALBOT, WICOMICO AND SOMERSET COUN-

TIES, and to repeal provisions for giving of notice to dredge or

hand scrape oysters from leased grounds during a certain period

of the year.

AN ACT TO REPEAL AND RE-ENACT, WITH AMENDMENTS,
SECTIONS 705 (A) AND (B) AND 708 (W) OF ARTICLE 66C
OF THE ANNOTATED CODE OF MARYLAND (1957 EDITION
AND 1964 SUPPLEMENT), TITLE "NATURAL RESOURCES,"
SUBTITLE "OYSTERS AND CLAMS," TO CHANGE THE
SEASON FOR TAKING OR CATCHING OYSTERS FOR SALE
FROM LEASED AREAS IN SOME COUNTIES OF THE
STATE, TO CHANGE PROVISIONS RELATING TO OYSTER
PACKERS' AND DEALERS' LICENSES, TO PERMIT PACK-
ERS AND DEALERS TO POSSESS SUCH OYSTERS AT ANY
TIME OF THE YEAR AND TO REPEAL PROVISIONS FOR
GIVING OF NOTICE TO DREDGE OR HAND-SCRAPE
OYSTERS FROM LEASED GROUNDS AT A CERTAIN TIME
OF THE YEAR.

Section 1. Be it enacted by the General Assembly of Maryland,

That Section 708 (w) of Article 66C of the Annotated Code of

Maryland (1957 Edition), title "Natural Resources," subtitle
"Oysters and Clams," be and it is
hereby repealed and re enacted,
with amendments, to read as follows:
THAT SECTIONS 705 (A)
AND (B) AND 708 (W) OF ARTICLE 66C OF THE ANNO-
TATED CODE OF MARYLAND (1957 EDITION AND 1964
SUPPLEMENT), TITLE "NATURAL RESOURCES," SUBTITLE
"OYSTERS AND CLAMS," BE AND THEY ARE HEREBY
REPEALED AND RE-ENACTED, WITH AMENDMENTS, TO
READ AS FOLLOWS:

705.

(A) IT SHALL BE UNLAWFUL FOR ANY PERSON, FIRM
OR CORPORATION HAVING A FIXED PLACE OF BUSINESS,
BUYING OYSTERS AND EMPLOYING LABOR TO PREPARE
THEM FOR MARKET TO ENGAGE IN THE BUSINESS OF
BUYING, SELLING, MARKETING, PACKING OR CANNING
OYSTERS WITHOUT FIRST TAKING OUT A LICENSE TO EN-
GAGE IN SUCH BUSINESS BY APPLICATION TO THE DE-
PARTMENT. WHERE ANY SUCH PERSON, FIRM OR
CORPORATION OPERATES MORE THAN ONE HOUSE FOR
THE BUYING, SELLING, MARKETING, PACKING OR CAN-
NING OF OYSTERS, A SEPARATE LICENSE SHALL BE OB-
TAINED FOR EACH HOUSE IN WHICH OYSTERS ARE
SHUCKED OR OTHERWISE PREPARED FOR MARKET; SUCH
LICENSE TO BE IN THE NATURE AND FORM OF A CON-
