J. MILLARD TAWES, Governor                       1587

TRACT BETWEEN THE STATE OF MARYLAND AND THE
APPLICANT, AND SHALL PROVIDE FOR THE PAYMENT OF
A LICENSE FEE OF TWENTY-FIVE DOLLARS ($25.00), AND
SHALL FURTHER PROVIDE THAT THE LICENSEE SHALL
TURN OVER TO THE STATE OF MARYLAND TWENTY-FIVE
PER CENT (25%) OF THE SHELLS FROM THE OYSTERS
SHUCKED IN HIS ESTABLISHMENT FOR THE CURRENT
SEASON, SAID SHELLS TO BE REMOVED ON OR BEFORE
THE TWENTIETH DAY OF AUGUST FOLLOWING. SAID
LICENSE SHALL HAVE EFFECT FROM THE FIRST DAY OF
SEPTEMBER IN THE YEAR IN WHICH IT MAY HAVE BEEN
OBTAINED UNTIL THE THIRTY-FIRST DAY OF AUGUST,
INCLUSIVE, NEXT SUCCEEDING.

(B) IT SHALL BE UNLAWFUL FOR ANY PERSON TO
TAKE OR CATCH OYSTERS OR TO HAVE OYSTERS IN HIS
POSSESSION BETWEEN THE FIFTEENTH DAY OF APRIL
TO THE FIRST DAY OF SEPTEMBER EACH YEAR, EXCEPT
THAT OYSTERS CAUGHT ON OR BEFORE THE FIFTEENTH
DAY OF APRIL MAY BE KEPT IN POSSESSION THROUGH
THE TWENTY-FIFTH DAY OF APRIL; PROVIDED, HOW-
EVER, THAT OYSTERS MAY BE TAKEN BY DREDGE OR
HAND SCRAPE AT ANY TIME IN WORCESTER COUNTY AND
MAY BE SHIPPED IN THE SHELL AT ANY TIME WITHIN
OR FROM SAID COUNTY. IN THOSE COUNTIES IN WHICH
OYSTERS ARE PERMITTED TO BE TAKEN FROM LEASED
AREAS AT ANY TIME UNDER THE PROVISIONS OF SECTION
708 (W) OF THIS ARTICLE, SUCH OYSTERS MAY BE IN
POSSESSION AT ANY TIME.

708.

(w) The season for taking or catching oysters for sale from
leased areas of this State shall be between sunrise and sunset of any
day, except Sunday, between the first day of October and the first
day of April, inclusive, next succeeding, except in Wicomico County,

where the season for taking or catching oysters shall be from the

first day of September to the fifteenth day of April, and except in St.
Mary's County and Worcester County, CHARLES, CALVERT,
ANNE ARUNDEL, TALBOT, WICOMICO, SOMERSET AND
WORCESTER COUNTIES, where oysters are permitted to be
taken and sold at any time [, and except in St. Mary's County,
where the season for taking or catching oysters shall extend to the
fifteenth day of April, inclusive; provided, however, that any lessee
desiring to take or catch oysters by dredge or hand scrape during
October, or during the last fifteen days of March, shall give written
notice of his intention so to do to the nearest officer of the Department
of Tidewater Fisheries, and such notice shall name the day and hour
when he intends to take or catch oysters and shall be mailed to said
officer at least three days in advance of the date named in the notice].

Sec. 2. And be it further enacted, That this Act shall take effect
June 1, 1965.
