1294                            LAWS OF MARYLAND                      [CH. 810

District within Montgomery County after July 1, 1965 1967 AND
GRANTING TO THE MONTGOMERY COUNTY COUNCIL,
UNDER CERTAIN CONDITIONS, THE RIGHT TO DESIG-
NATE THE DISPOSAL SITE, PLANT OR LOCATION WITHIN
SAID COUNTY WHICH SHALL BE UTILIZED BY THE
COMMISSION FOR THE DISPOSAL OF GARBAGE, TRASH
AND REFUSE COLLECTED WITHIN SAID COUNTY.

Section 1. Be it enacted by the General Assembly of Maryland,
That new Section 83-97A of the Public Local Laws of Prince George's
County (1963 Edition), and new Section 73-79A of the Montgomery
County Code (1960 Edition), being Articles 17 and 16, respectively,
of the Code of Public Local Laws of Maryland, titles "Prince George's
County" and "Montgomery County," subtitle "Washington Suburban
Sanitary District," be and it is hereby added, to follow immediately
after Sections 83-97 and 73-79 of the respective Codes, and to read
as follows:

83-97A.
73-79 A.

On and after July 1, 1965 1967, (1) FROM AND AFTER THE
EFFECTIVE DATE OF ANY AGREEMENT BETWEEN THE
COMMISSION AND THE MONTGOMERY COUNTY COUNCIL,
RELATING TO THE TERMINATION IN MONTGOMERY
COUNTY OF ANY REFUSE COLLECTION OR DISPOSAL SYS-
TEM, OPERATED, INSTITUTED OR MAINTAINED BY THE
COMMISSION IN SAID COUNTY, the Commission shall have no
authority to institute, maintain or operate a system of refuse collec-
tion and disposal in any part or parts of the Sanitary District within
Montgomery County and it shall cease any such system prior to said
date, any law or act to the contrary notwithstanding; provided that
SAID AGREEMENT SHALL PROVIDE THAT Montgomery
County shall pay the interest on and redeem at maturity any out-
standing bonds which have been issued by the Commission to finance
any refuse or disposal system in Montgomery County
UNLESS THE
COMMISSION CONSENTS TO WAIVE SAID REQUIREMENT,
and if necessary, Montgomery County shall levy a tax to pay any
such interest or to redeem said bonds.
; AND PROVIDED FUR-
THER THAT SAID AGREEMENT SHALL PROVIDE THAT THE
ACCRUED EMPLOYMENT BENEFITS, INCLUDING, BUT NOT
LIMITED TO, ACCUMULATED SICK LEAVE, AS OF THE EF-
FECTIVE DATE OF SAID AGREEMENT, OF THE EMPLOYEES
OF THE COMMISSION'S REFUSE AND GARBAGE COL-
LECTION AND DISPOSAL DIVISION SHALL BE GUARAN-
TEED AND IN NO EVENT ABROGATED.

(2) FROM AN© AFTER WITHIN FOUR MONTHS SUBSE-
QUENT TO THE DATE ON WHICH THE MONTGOMERY
COUNTY COUNCIL OR ITS DESIGNATED AGENT, NOTIFIES
THE COMMISSION IN WRITING OF THE ESTIMATED AC-
TUAL DATE OF COMPLETION OF ANY INCINERATOR
LOCATED IN OR OWNED BY MONTGOMERY COUNTY, AND
DESIGNED FOR THE DISPOSAL OF GARBAGE, TRASH, RUB-
BISH OR REFUSE OWNED BY MONTGOMERY COUNTY, AND
REQUESTS ITS USE, AND A SUITABLE ACCESS ROAD HAS
