CHAPTER 119

(Senate Bill 268)

AN ACT to add a new sub-section to Section 32 of Article 89B of the
Annotated Code of Maryland (1957 Edition, 1964 Replacement
Volume), title, "State Roads", sub-title "Distribution and Use of
Special Funds", said new sub-section to be known as sub-section
(g) of Section 32 and to follow immediately after sub-section (f)
of Section 32 of said Article of said Code, authorizing the State
Roads Commission to create a fund to be known as the "County
Highway Construction Fund", and from this authorizing the Com-
mission to transfer certain funds to such accounts, under certain
conditions, which funds may be allocated to the several counties
for highway construction or reconstruction purposes under certain
conditions.

Section 1. Be it enacted by the General Assembly of Maryland,
That one new sub-section be and is hereby added to Article 89B of
the Annotated Code of Maryland (1957 Edition, 1964 Replacement
Volume), title "State Roads", sub-title "Distribution and Use of
Special Funds", said new sub-section to be known as sub-section (g)
of Section 32 and to follow immediately after sub-section (f) of
Section 32 of said Article of said Code, and to read as follows:

32.

(g) The State Roads Commission, with the consent of the Gov-
ernor and under the provisions of Section 8 of Article 15A may, in
any fiscal year, transfer from the Construction Fund prescribed in
this Section to a "County Highway Construction Fund", which is
hereby established, a sum equal to such amount of Federal Aid Sec-
ondary Highway Funds that may become available from the Bureau
of Public Roads and that may be allocated by the State Roads Com-
mission to the several counties and that may subsequently be released
by such counties to the State Roads Commission for use on the State
Highway System. Such County Highway Construction Fund shall be
subject to apportionment by the State Roads Commission and match-
ing construction funds shall be required of each such county par-
ticipating in such program. Such County Highway Construction Fund
and such matching funds shall be expended only for highway con-
struction and reconstruction projects under such rules and regulations
as the Commission shall determine.

Sec. 2. And be it further enacted, That this Act shall take effect
June 1, 1965.
