an application fee. If the applicant satisfactorily passes an appro-
priate examination conducted by the State Board of Agriculture, he
shall be entitled to receive the kind of license for which he qualifies
upon the payment of fees. All licenses shall be good for the license
year of issue unless revoked or suspended and shall be renewable
annually without examination upon application and payment of a
renewal fee.
All fees to be paid under the provisions of this sub-title shall be
accounted for by the Maryland State Board of Agriculture to the
State Comptroller and shall be used in enforcing the provisions of
these sections.
92—SAMPLES—
Samples used as a basis for payment to the producer shall be
taken, maintained and tested in the manner and within the period
of time specified by the State Board of Agriculture or its authorized
agent.
No test of a sample that has been altered in any manner so that
it tests lower or higher than the test of the milk or other fluid dairy
product from which it was taken shall be used as a basis for payment.
93—CORRECT WEIGHT, MEASURE AND TEST—
No person shall use as a basis of payment to any producer of milk
or other fluid dairy product any weight, measure or test which is
lower or higher than the weight, measure or test of the product from
which it was taken as determined by the procedures approved by
the State Board of Agriculture or its authorized agent.
94—PRODUCER RECEIPT AND RECORDS—
Every person required by Sec. 86 of this sub-title to have a permit
shall notify the producer of the results of the tests and the basis of
payment and shall maintain records of such tests and payment in a
manner as specified by the State Board of Agriculture or its author-
ized agent.
95—INSPECTION AND CHECK TESTING—
The State Board of Agriculture or its agent is hereby authorized
to enter the premises of any person required by Sec. 86 of this sub-
title to have a permit, at any and all reasonable hours, to examine
the weighing, measuring, sampling and testing apparatus, to take
samples of milk and/or other fluid dairy products, to check weights,
measures and test results and to inspect, AND audit and copy all
books, papers, records or documents bearing thereon. All information
obtained by the State Board of Agriculture from the records of any
person shall be kept confidential by all officers and employees, and
only such information required to be revealed in any proceedings
brought under this sub-title shall be disclosed; and nothing herein
shall be deemed to prohibit the compilation of statistical reports
from the information so acquired from a number of persons pro-
vided the compilation does not identify the person furnishing any
specific information.
