96—REVOCATION OF PERMITS OR LICENSES—

Any permit or license issued under the provisions of this sub-title
may be revoked or suspended by the Maryland State Board of Agri-
culture or its authorized agent upon satisfactory proof that the
permit or license holder has violated any provisions of this sub-title
or any of the rules and regulations promulgated thereunder. No
such permit or license shall be revoked or suspended until the holder
thereof has been given a hearing by the State Board of Agriculture
or its authorized agent after due notice.

97—PENALTIES FOR VIOLATIONS—

Any person guilty of violating any of the provisions of this sub-
title, excepting Sections 89 and 93, upon conviction shall be subject
to a fine not to exceed $100.00 or be imprisoned not more than 80
days, or be both fined and imprisoned, in the discretion of the court.

Any person guilty of violating Sections 89 and 98 of this sub-
title, upon first conviction shall be subject to a fine of not less than
$100.00 not to exceed $1,000.00 or be imprisoned not more than 9
months, or both; and upon each subsequent conviction shall be sub-
ject to a fine of not less than $1,000.00 or be imprisoned not more
than 9 months, or both; each sentence to be within the discretion of
the court.

Sec. 2. And be it further enacted, That any and all statutes of
this State which are in conflict with any of the provisions of this
sub-title are, to the extent of such conflict, hereby repealed and
superseded by this sub-title.

Sec. 3. And be it further enacted, That should any section, para-
graph, clause or sentence of this sub-title be declared unconstitu-
tional or invalid for any reason, the remainder of the said sub-title
shall not be hereby affected.

Sec. 4. And be it further enacted, That nothing in this sub-title
shall be construed to interfere with any prosecutions which may
have been commenced for any violations of any of the sections
which are repealed by this sub-title where such violations occurred
prior to the enactment of this law.

Sec. 5. And be it further enacted, That the Maryland State
Board of Agriculture is empowered to enter into agreement with
legally constituted authorities of other states on uniform procedures
of control of the weighing, measuring, sampling and testing of milk
or other fluid milk products for shipment to dairy plants in the
respective states. No procedure agreed upon shall be in conflict with
Maryland or Federal legal requirements.

Sec. 6. And be it further enacted, That this Act shall take effect
June 1, 1965.
