Formed by Channel Excavation in Sinepuxent, Isle of Wight and
Chincoteague Bays," "Part 1. General Provisions", "Part 2. Tidal
Waters" and "Part 3. Crabs, Lobster and Terrapins," to transfer
from the jurisdiction of the Board of Natural Resources to other
State agencies or departments certain powers and duties relating
generally to marking of State boundaries, artificial islands, fish
ladders, taking of sturgeon, bass, pike and crabs, making correc-
tions therein, and relating generally to the natural resources of
the State.

Section 1. Be it enacted by the General Assembly of Maryland,
That Sections 31, 32, 33, 246, 294, 314(b) and 329 of Article 66C
of the Annotated Code of Maryland (1957 Edition and 1963 Sup-
plement), title "Natural Resources," subtitles respectively "In Gen-
eral" and "Fish and Fisheries," subheadings respectively "State
Boundaries," "Lands Formed by Channel Excavation in Sinepuxent,
Isle of Wight and Chincoteague Bays," "Part 1. General Provisions,"
"Part 2. Tidal Waters," and "Part 3. Crabs, Lobster and Terrapins,"
be and they are hereby repealed and re-enacted, with amendments,
and all to read as follows:

31.

The monuments marking the common boundary between the
State of Maryland and any adjacent state, commonwealth or district
are hereby declared to be the joint property of the State of Maryland
and such adjoining state, commonwealth or district.

The [Board of Natural Resources and its component departments
are] Department of Forests and Parks is hereby authorized to ex-
amine from time to time, at least once in every ten years, the monu-
ments marking the boundaries of this State. Whenever the [Board
of Natural Resources and its constituent departments] Department
shall find the monuments marking the boundary between Maryland
and any other state, commonwealth or district have been lost, re-
moved or displaced so that the boundary thereby becomes obscure,
inaccurate or incorrect, [the Board of Natural Resources and its de-
partments] it shall cooperate with the proper officials and agencies of
the adjacent state, commonwealth or district in the replacement,
restoration or repair of the monuments on the said common bound-
ary line. The [Board of Natural Resources] Department is further
authorized, on behalf of the State of Maryland, to make joint agree-
ments and to enter into joint contracts with appropriate officials or
agencies of any adjacent state, commonwealth or district, and with
the United States Coast and Geodetic Survey or any similar disin-
terested party or agency, to resurvey, remark or otherwise delineate
more clearly any part of any common boundary between the State of
Maryland and any adjacent state, commonwealth or district; pro-
vided, however, that in any resurvey the present established bound-
aries of this State shall be preserved with the greatest possible
fidelity.

The [Board of Natural Resources and its component departments,
and the] Department and its authorized agents and employees [of
the Board,] are hereby authorized and empowered to enter upon any
property, public or private, for the purpose of examining any bound-
ary monument; provided, however, that this section shall not author-
ize the [Board] Department or its agents [or departments] to enter
