petition with the Commission asking for a hearing on the decision,
rule or regulation. The petition shall set forth the grounds and rea-
sons for the petitioner's complaint. The Chairman shall set a time
and place for the hearing and shall notify the petitioner. At the
hearing, the petitioner and any other interested parties may appear
in person or by counsel, present witnesses and submit evidence. The
Chairman or any member of the Commission shall have the power to
administer oaths to any witnesses who appear to testify at the hear-
ing. The Chairman may issue summons for any witnesses to appear
and testify at the hearing, which shall be served by the Sheriff of
Baltimore City or by the sheriff of any county. If any witness so
summoned shall refuse to testify, the Chairman may apply to the
Baltimore City Court or to the circuit court for any county, and the
court is authorized to take such action as may be taken against a
witness summoned to said court who shall refuse to testify. The
Commission shall as promptly as possible after the hearing render a
final decision on the petitioner's complaint.
56. Any party aggrieved by a final decision of the Commission is
entitled to judicial review thereof as provided by the Administrative
Procedure Act, Section 255 of Article 41 of this Code.
Miscellaneous Provisions
57. It shall be the duty of the Attorney General of the State of
Maryland to take charge of and prosecute all cases arising under the
provisions of this article including the recovery of penalties.
58. Whenever in this article or in the laws of this State reference
is made to the Water Pollution Control Commission and the De-
partment of Geology, Mines and Water Resources, respectively, the
same shall, after June 1, 1964, be taken to refer respectively to the
Department of Water Resources and to the Maryland Geological Sur-
vey.
59. If any provision of this article or the application thereof to any
person or circumstances is held invalid, such invalidity shall not
affect the other provisions or any other application of this article
which can be given effect without the invalid provision or applica-
tion, and to this end the provisions of this article are hereby declared
to be severable.
Sec. 3. And be it further enacted, That this Act shall take effect
June 1, 1964.
