and of other State agencies. The program shall serve as a guide to the
Department in the performance of its duties as hereinafter provided.
7. The Department is authorized and empowered to make or cause
to be made, such surveys, maps, investigations and studies of the
water resources of the State as it may deem necessary to provide
it with sufficient information to formulate a program, and to per-
form its duties. The Department is further authorized to contract
for research or scientific investigation with the Natural Resources
Institute of the University of Maryland, the Chesapeake Bay Insti-
tute of the Johns Hopkins University or other appropriate research
organization.
8. The Department is authorized to conduct a joint study with
the State Departments of Game and Inland Fish and Chesapeake
Bay Affairs in order to define the boundaries of tidal and non-tidal
waters within the jurisdiction of the State. The boundaries of said
waters as determined by the study shall be set forth in regulations
promulgated by the Department.
9. In addition to the powers and duties stated herein, the Depart-
ment shall exercise those responsibilities reasonably necessary
in carrying out the intention of this article.
Other Powers and Functions
51. The Department shall be responsible for and cooperate with
the federal and local governments in developing and carrying out a
long range program for controlling flood waters in the State and,
in addition, shall serve in a liaison capacity to said governments in
all matters pertaining to flood control.
52. The Department shall provide technical assistance to local gov-
ernments and other State agencies in interpreting flood information
and in drafting local land use and other regulations pertaining to
areas subject to flooding. The Department shall review plans for
local public works and shall further exercise regulatory control over
all such works in or on the waters of the State as provided for in
Sections 10 through 21, inclusive, of this article.
53. The Department shall administer such financial assistance for
flood control as may be made available for this purpose.
54. When the General Assembly shall determine that it is neces-
sary to acquire interests or rights in real property for sound and
proper land and watershed management and for other purposes in
the public interest, the State may acquire such interests or rights by
purchase, gift, grant, bequest, devise or lease, the fee or any lesser
interest, development, right, easement, covenant or as provided else-
where in the laws of Maryland. To achieve these purposes, the De-
partment may receive, expend, and otherwise administer any contri-
butions, donations or appropriations which may be made available
by the United States, State of Maryland, other political communities
and/or private persons.
Appeals
55. Any person or party aggrieved by a final decision of the De-
partment, whether such decision is affirmative or negative in form,
or by any rule or regulation of the Department, may file a sworn
