Any person or persons taking and carrying away fish belonging
to another person [, with intent to convert the same to their own
use,] from any boat, live box, or in the pocket or crib of any pound
net or inclosed or gilled in a fish net of any kind, or taking or carry-
ing away nets or any gear used, in taking or catching fish
shall be
guilty of a misdemeanor, and upon trial and conviction shall be fined
a sum not exceeding $100, or sentenced to the county jail in the
county where he shall be first brought for trial, or to the Maryland
House of Correction, for a period not exceeding two years, or both
fine and imprisonment.

Sec. 2. And be it further enacted, That this Act shall take effect
June 1, 1963.

CHAPTER 521
(House Bill 826)

AN ACT to repeal and re-enact, with amendments, Section 702 (b)
of Article 66C of the Annotated Code of Maryland (1957 Edition),
title "Natural Resources," subtitle "Oysters and Clams," to change
the manner of application for a Chesapeake Bay oyster dredging
license and relating to the form of and the transmission of copies
of the license application.

Section 1. Be it enacted by the General Assembly of Maryland,
That Section 702 (b) of Article 66C of the Annotated Code of Mary-
land (1957 Edition), title "Natural Resources," subtitle "Oysters and
Clams," be and it is hereby repealed and re-enacted, with amend-
ments, to read as follows:

702.

(b) Any person wishing to take or catch oysters by dredge in the
Chesapeake Bay shall [appear before the Department of Tidewater
Fisheries and make] apply to the clerk of the circuit court of the
county wherein the person resides for an
application for a Chesa-
peake Bay dredging license. Every such applicant shall exhibit
to said [Department] clerk a custom house certificate showing the
name, size and gross tonnage of the dredge boat to be used and
make oath or affirmation that he is the bona fide owner of such boat;
that there is no lien on said boat held by a nonresident of Maryland;
that he has been a resident of the State for one year prior to the
making of such application; that the custom house certificate is a
true and just certificate; and that said boat contains no dunnaging,
false ceiling, false deck, false floor or any other structures calculated
to conceal any cargo space or haying the effect of concealing any
cargo space. The application for license shall be completed in dupli-
cate and the clerk shall promptly send a copy of the application to the
Department of Tidewater Fisheries.

Sec. 2. And be it further enacted, That this Act shall take effect
June 1, 1963.
