CHAPTER 400
(House Bill 595)

AN ACT to repeal and re-enact, with amendments, Section 76 (c) of
Article 26 of the Annotated Code of Maryland (1957 Edition and
1962 Supplement), title "Courts," subtitle "Juvenile Causes in
Montgomery County," to provide that the People's Court judge for
juvenile causes for Montgomery County shall have the power to
appoint a guardian of the person for any child coming under the
terms of the section.

Section 1. Be it enacted by the General Assembly of Maryland,
That Section 76 (c) of Article 26 of the Annotated Code of Mary-
land (1957 Edition and 1962 Supplement), title "Courts," subtitle
"Juvenile Causes in Montgomery County," be and the same is hereby
repealed and re-enacted, with amendments, to read as follows:

76.

(c) He shall have power to place any child found to be delinquent,
dependent or neglected, or a child without proper care and guardian-
ship in the custody of such person or persons, juvenile institution or
juvenile agency, or to appoint a guardian of the person therefor, for
such period of time as may be deemed for the best interest and welfare
of said child, if it shall appear that the present custodian or parent
is not a fit person to have the custody of such child, or that it would be
conducive to the best interest of such child to have a change of cus-
todian or to be placed under guardianship. A guardian appointed
hereunder shall have no control over the property of his ward, unless
and until he shall apply for and receive such authority under other
applicable provisions of this Code.

Sec. 2. And be it further enacted, That this Act shall take effect
June 1, 1963.

CHAPTER 401
(House Bill 672)

AN ACT to repeal and re-enact, with amendments, Section 255 (i)
of Article 93 of the Annotated Code of Maryland (1957 Edition),
title "Testamentary Law," subtitle "Orphans' Court," providing a
mileage allowance for the judges of the orphans court in Wicomico
County.

Section 1. Be it enacted by the General Assembly of Maryland,
That Section 255 (i) of Article 93 of the Annotated Code of Maryland
(1957 Edition), title "Testamentary Law," subtitle "Orphans' Court,"
be and it is hereby repealed and re-enacted, with amendments, to
read as follows:
