SEC. 3. And be it further enacted, That this Act shall take effect

CHAPTER 399
(House Bill 592)

AN ACT to add new Section 288A to the Code of Public Local Laws
of Cecil County (1961 Edition), being Article 8 of the Code of
Public Local Laws of Maryland, title "Cecil County," to follow im-
mediately after Section 288 thereof and to be under the new sub-
title "Peddlers," to require the registration with the County Com-
missioners of Cecil County of persons peddling or selling goods,
wares or merchandise from door-to-door in the county, relating to
such registration and providing penalties for violations.

Section 1. Be it enacted by the General Assembly of Maryland,
That new Section 288A be and it is hereby added to the Code of Pub-
lic Local Laws of Cecil County (1961 Edition), being Article 8 of the
Code of Public Local Laws of Maryland, title "Cecil County," to fol-
low immediately after Section 288 thereof and to be under the new
subtitle "Peddlers," and to read as follows:

288A.

(a)  It is unlawful for any person who is not a resident of Cecil
County to conduct the business of or act as an itinerant or door-to-
door peddler or salesman of goods, wares or merchandise, either by
sample or otherwise in Cecil County unless he has registered with
the County Commissioners.

(b)  The County Commissioners shall prepare and have available
application forms for a peddler's license, containing such provisions
and information as in the opinion of the County Commissioners may
be necessary to keep a proper and complete listing of the persons in
Cecil County who are engaged in this occupation from time to time.
The license shall be issued upon application at a cost of five dollars
($5.00) for each year; and the cost shall not be prorated for portions
of a year. The license year begins as of January 1.

(c)  Nothing in this section shall be construed or used to apply to
any person who is going from door-to-door in any activity or enter-
prise which is conducted for and on behalf of any nonprofit, chari-
table, or eleemosynary agency or organization; or to any person who
is going from door-to-door in the sale of farm produce or seafood
of any kind which he has produced or taken within the limits of Cecil
County; or to any person who is selling or delivering newspapers.

(d)  Any person who violates any provision of this section is guilty
of a misdemeanor, and shall be subject upon conviction thereof to
a fine not to exceed five hundred dollars ($500.00) or to imprisonment
for not to exceed three (3) months, or both for each violation.

Sec. 2. And be it further enacted, That this Act shall take effect
June 1, 1963.
