450                             LAWS OF MARYLAND                      [CH. 252

TIRED MEMBER OR EMPLOYEE AT THE TIME OF HIS RE-
TIREMENT. UNDER NO CIRCUMSTANCES SHALL PAY-
MENTS EXCEED AN AMOUNT EQUAL TO SIXTY-FIVE PER
CENTUM OF THE CURRENT BASE PAY. SUCH DISABILITY
PAYMENTS SHALL BE MADE ONLY UPON CERTIFICATION
OF THE CHIEF POLICE PHYSICIAN AND THREE ASSOCI-
ATE POLICE PHYSICIANS THAT THE PERMANENT DIS-
ABILITY WAS INCURRED DURING THE DISCHARGE OF
DUTY.

(B) MEMBERS OF THE POLICE FORCE IN ACTIVE SERV-
ICE ON JANUARY 1, 1964, WHO ARE DENIED A DISABILITY
PENSION UNDER SUB-SECTION (A) OF THIS SECTION,
HAVE A RIGHT TO APPEAL TO THE BALTIMORE CITY
COURT. THE COURT OR JURY MAY AFFIRM, REVERSE, OR
MODIFY THE ACTION OF THE POLICE DEPARTMENT IN
THE CASE.

Sec. 2. And be it further enacted, That this Act shall take effect
January 1, 1964.

(Senate Bill 331)

AN ACT to repeal and re-enact, with amendments, Section 299 of
Article 4 of the Code of Public Local Laws of Maryland and Balti-
more City Charter (1919 Edition), title "Baltimore City", sub
-
title "Criers, Bailiffs, Watchmen and Stenographers", as said
Section was amended by Chapter 85 of the Acts of 1955, providing
that the court stenographers of the several courts of Baltimore
City shall receive additional compensation in the form of salaries
and pensions.

THE CODE OF PUBLIC LOCAL LAWS OF BALTIMORE CITY
(1949 EDITION, BEING ARTICLE 4 OF THE CODE OF PUB-
LIC LOCAL LAWS OF MARYLAND), TITLE "BALTIMORE
CITY", SUB-TITLE "CRIERS, BAILIFFS, WATCHMEN AND
STENOGRAPHERS", AS SAID SECTION WAS AMENDED BY
CHAPTER 85 OF THE ACTS OF 1955, RELATING TO THE
NUMBER AND APPOINTMENTS OF COURT STENOGRA-
PHERS IN BALTIMORE CITY AND TO THE PAYMENT OF
A PENSION OR RETIREMENT SALARY THERETO.

Section 1. Be it enacted by the General Assembly of Maryland,
That Section 299 of Article 4 of the Code of Public Local Laws of
Maryland and Baltimore City Charter (1949 Edition), title "Balti-
more City", sub title "Criers, Bailiffs, Watchmen and Stenogra-

phers", as said Section was amended by Chapter 85 of the Acts of
