(A) ON AND AFTER JANUARY 1, 1958, IN ADDITION TO
THE PAYMENTS MADE TO MEMBERS OF THE POLICE
FORCE AND OTHER EMPLOYEES OF THE POLICE DEPART-
MENT WHO HAVE BEEN RETIRED BY REASON OF PERMA-
NENT DISABILITY INCURRED IN THE DISCHARGE OF
THEIR DUTIES, OR WHO SHALL HEREAFTER BE RETIRED
BY REASON OF PERMANENT INJURIES INCURRED IN THE
DISCHARGE OF THEIR DUTIES UNDER THE PROVISIONS
OF SECTION 591, THERE SHALL BE PAID MONTHLY AN
AMOUNT EQUAL TO FIFTEEN PERCENT (15%) OF THE
MONTHLY BASE PAY OR SALARY OF THOSE MEMBERS OF
THE POLICE FORCE OR OTHER EMPLOYEES OF THE
POLICE DEPARTMENT IN ACTIVE SERVICE OCCUPYING A
GRADE, RANK OR CLASSIFICATION OCCUPIED BY THE RE-

CHAPTER 251
(Senate Bill 330)

AN ACT to repeal Section 591B of the Charter and Public Local
Laws of Baltimore City (1949 Edition, being Article 4 of the Code
of Public Local Laws of Maryland), title "Baltimore City", sub-
title "Police Commissioner", sub-heading "Special Fund", as said
section was last amended by Chapter 787 of the Acts of 1957, and
to enact new Section 591B in lieu thereof to stand in the place of
the section so repealed, relating to payments by Baltimore City
to members of the Police Force of the City retired by reason of
disability* AND PROVIDING FOR AN APPEAL FROM THE
DENIAL OF ANY OF THE DISABILITY PAYMENT UNDER
THIS ACT.

Section 1. Be it enacted by the General Assembly of Maryland,
That Section 591B of the Charter and Public Local Laws of Balti-
more City (1949 Edition, being Article 4 of the Code of Public Local
Laws of Maryland), title "Baltimore City", sub-title "Police Com-
missioner", sub-heading "Special Fund", as said section was last
amended by Chapter 787 of the Acts of 1957, and to enact BE AND
IT IS HEREBY REPEALED, AND THAT new Section 591B BE
AND IT IS HEREBY ENACTED in lieu thereof, to stand in the
place of the section so repealed, and to read as follows:

591B.

On and after January 1, 1958 , 1964, the payments made to members
of the police force and other employees of the Police Department who

have been retired by reason of any disability sustained or incurred

while on duty and/or have been injured while on duty and as a

result of such disability and/or injury have lost time from active

duty, or who shall hereafter be retired by reason of permanent

injuries incurred in the discharge of their duties under the provi-

sions of Section 591, shall be paid monthly an amount equal to fifteen

percent (15%) of the monthly base pay or salary of those members

of the police force or other employees of the Police Department in
active service occupying a grade, rank or classification occupied by
the retired member or employee at the time of his retirement. Under

no circumstances shall payments exceed an amount equal to sixty-

five (65) per centum of the current base pay.
