(a) The several sheriffs in this State may charge and collect these
fees:
(1) For any action or service which involves only the serving of
a paper and is not an act of execution or attachment, a fee of $2.00.
(2) For any action or service which includes an act of execution
or attachment, involving a seizure or a taking into custody of any
property, real or personal, or of any person, a fee of $4.00. IF THE
SHERIFF INCURS ANY ACTUAL EXPENSES FOR THE PUR-
POSE OF CONSERVING AND PROTECTING PROPERTY
SEIZED, HE SHALL BE ENTITLED TO REIMBURSEMENT
FOR SUCH EXPENDITURES.
(b) If the act of execution or attachment leads into an actual sale
of property, the several sheriffs may charge and collect an additional
poundage fee, computed on the sale price of the property sold, as
follows:
(1) For personal property: 3% of the first $5,000.00 of sale price,
plus 2% of the second $5,000.00 of sale price, plus 1% of any portion
of the sale price in excess of $10,000.00. Under this paragraph in
any event, the minimum fee is $3.00 and the maximum fee is $500.00.
(2) For real property: 1½% of the first $5,000.00 of sale price,
plus 1% of the second $5,000.00 of sale price, plus ½ of 1% of any
portion of the sale price in excess of $10,000.00. Under this para-
graph in any event, the minimum fee is $1.50 and the maximum fee
is $250.00.

the place of the sections so repealed; and to repeal and to re enact,
with amendments, Section 25(c) of said Article and subtitle, re-
vising the provisions concerning the fees of sheriffs in this State
and relating generally to fees of sheriffs for the several services
and duties they perform and to the mileage fees for the Sheriff of
Frederick County.
Section 1. Be it enacted by the General Assembly of Maryland,
That Sections 25(a), 25(b), 25(C), 25(d), 25(e) and 26 of Article 36
of the Annotated Code of Maryland (1957 Edition and 1962 Supple-
ment), title "Fees of Officers," subtitle "Sheriffs," be and they are
hereby repealed and that new Sections 25 (a) and 25(b) be and they
are hereby enacted to stand in the place of the sections so repealed;
and to repeal and re enact, with amendments, Section 25(c) of said
Article and subtitle, all to read as follows:
25.
(c) The Sheriff of Frederick County shall be entitled to charge
and receive the following fee in addition to those provided for in
subsections (a) and (b), to wit:
For every mile traveled in the performance of any duty imposed
where trial magistrates sit or the City of Frederick for which no
mileage allowance has been provided elsewhere in this article, but
not for the return—ten (10) cents per mile. Provided, however, that
whenever the said Sheriff or his deputy shall make more than one
trip to carry out any one particular duty, he shall be entitled to the
said mileage allowance for the first trip only.
