1961 Supplement) being Article 2 of the Code of Public Local Laws
of Maryland, title "Anne Arundel County," subtitle "Chapter 3.
Animals and Fowl," subheading "Article II. Dogs," to follow imme-
mediately after Section 3-30 thereof, relating to the responsibilities
of owners for keeping dogs under control in Anne Arundel County
and providing penalties for their failure to do so, AND CHANG-
ING CERTAIN FEES AND CHARGES FOR LICENSING, PICK-
ING UP AND BOARDING DOGS.
Section 1. Be it enacted by the General Assembly of Maryland,
That new Section 3-31.1 be and it is hereby added to the Code of
Public Local Laws of Anne Arundel County (1957 Edition and 1961
Supplement), being Article 2 of the Code of Public Local Laws
of Maryland, title "Anne Arundel County," subtitle "Chapter 3.
Animals and Fowl," subheading "Article II. Dogs," to follow imme-
diately after Section 3-30 thereof, and to read as follows:
3-31.1.
(a) No owner of a dog, whether licensed or unlicensed, shall permit
such dog to run at large off the premises of the owner in Anne
Arundel County, except when it is under the control of the owner
or an authorized agent of the owner by leash, cord, or chain; pro-
vided, however, certain dogs will be permitted to run at large when
accompanied by the owner or an authorized agent and kept
within sight or calling distance, that is to say: (i) dogs proven to
be obedient, in accordance with regulations to be promulgated by
the Maryland Society for the Prevention of Cruelty to Animals of
Anne Arundel County (hereinafter referred to as the S.P.C.A.)
COUNTY COMMISSIONERS OR THEIR AGENTS; (ii) dogs being
used for hunting, or trained for hunting and (iii) dogs being accom-
panied by the owner on horseback.
(b) The S.P.C.A. will investigate any reports of violations and
shall seize or cause to be seized any dog seen at large. If, upon
investigation of any report of violations, the dog is not in
sight and the owners of the dog are known by the complainant, the
S.P.C.A. will make available an "Order of Complaint" which may
be completed by complainant and which should also bear the signa-
tures of two other residents in the same area attesting to the vio-
lation. When there is no previous seizing of the dog or previous
complaint against the owner, the dog, if seized, shall be returned to
the owner, and the S.P.C.A. may issue to the owner a written warn-
ing. A copy of any such warning shall be filed in the office of the
S.P.C.A. The S.P.C.A. in the enforcement of the provisions of this
act shall use the services and personnel of the Humane Society of
Anne Arundel County.
(c) Where there is a record of a previous seizing of a dog or
previous complaint against an owner upon seizing the dog or upon
receipt of a properly completed "Order of Complaint," the Dog, if
seized, shall be returned to the owner, and the S.P.C.A. may cause
summons to be issued to the owner of said dog.
(d) Any owner failing to comply with the provisions of this sec-
tion after a warning has been issued in accordance with the pro-
visions of subsection (b) hereof shall be guilty of a misdemeanor,
