and upon conviction thereof before any trial magistrate of the

county or in the Circuit Court for the county, shall be subject to a

fine of not more than twenty-five dollars for a first offense and not

more than fifty dollars for each subsequent offense.

(e) The owner of any dog seized as above provided, may reclaim

it within ninety six hours from the time of its apprehension, first,

by describing it in some fair manner and proving ownership, and

then by securing a current license and tag, if not already secured,

and paying the board bill for the time the dog is held at a duly estab-

lished shelter. The office of the S.P.C.A. shall be notified of the

claiming of any dog under this section.

(B). SUBSECTION (A) OF THIS SECTION SHALL NOT APPLY
TO (1) DOGS BEING USED FOR HUNTING, OR BEING TRAINED
FOR HUNTING, UNDER SUPERVISION OF THE OWNER; AND
(2) DOGS BEING ACCOMPANIED BY THE OWNER ON HORSE-
BACK.

(C)  COMPLAINTS AND REPORTS OF ANY VIOLATIONS OF
THIS SECTION SHALL BE INVESTIGATED BY THE APPRO-
PRIATE ENFORCEMENT AUTHORITIES UNDER ARTICLE II
HEREOF. IF, UPON INVESTIGATION OF ANY REPORTS OF
VIOLATIONS, THE OWNERS OF THE DOG ARE KNOWN BY
THE COMPLAINANT, THE ENFORCEMENT AUTHORITIES WILL
MAKE AVAILABLE AN "ORDER OF COMPLAINT" WHICH MAY
BE COMPLETED BY THE COMPLAINANT, AND WHICH MUST
ALSO BEAR THE SIGNATURES OF TWO OTHER RESIDENTS
IN THE SAME AREA ATTESTING TO THE VIOLATION AND
MUST BE RETURNED TO THE OFFICE OF THE ENFORCE-
MENT AUTHORITIES.

(D)  IF THE OWNER FAILS TO COMPLY WITH THESE PRO-
VISIONS AFTER A WARNING HAS BEEN GIVEN IN ACCORD-
ANCE WITH SUBSECTION (C) HEREOF, THEN THE APPRO-
PRIATE ENFORCEMENT AUTHORITIES MAY SEIZE AND IM-
POUND ANY DOG FOUND IN VIOLATION OF SUBSECTIONS
(A) HEREOF.

(E)  ANY DOG SEIZED AND IMPOUNDED UNDER THE PRO-
VISIONS OF THIS SECTION SHALL BE RELEASED ONLY UPON
PAYMENT OF ONE DOLLAR ($1.00) PICKUP CHARGE, A FIVE
DOLLAR ($5.00) POUND FEE, AND BOARD CHARGES FOR
EACH DAY, OR FRACTION OF A DAY, DURING WHICH THE
DOG IS IMPOUNDED AT THE RATE OF ONE DOLLAR ($1.00)
PER DAY OR FRACTION THEREOF. IF THE IMPOUNDED DOG
BE UNLICENSED, THEN THE DOG SHALL NOT BE RELEASED
UNTIL THE PAYMENT OF THE PRESCRIBED LICENSE FEE IS
ALSO MADE.

(F)   ANY OWNER WHO REPEATEDLY FAILS TO COMPLY
WITH THE PROVISIONS OF THIS SECTION AFTER A WARN-
ING HAS BEEN ISSUED IN ACCORDANCE WITH SUBSECTION
(C) HEREOF SHALL BE GUILTY OF A MISDEMEANOR, AND
UPON CONVICTION THEREOF BEFORE ANY TRIAL MAGI-
STRATE OF THE COUNTY OR IN THE CIRCUIT COURT FOR
THE COUNTY, SHALL BE SUBJECT TO A FINE OF NOT MORE
THAN TWENTY-FIVE DOLLARS FOR A FIRST OFFENSE, AND
