to bring records held in a custodial or fiduciary capacity within
the scope of the Uniform Photographic Copies of Business and
Public Records as Evidence Act.
Section 1. Be it enacted by the General Assembly of Maryland,
That Sub-section 60(a) of Article 35 of the Annotated Code of
Maryland (1957 Edition), title "Evidence," subtitle "Proof of Ac-
counts," be and it is hereby repealed and re-enacted, with amend-
ments, to read as follows:
60.
(a). If any business, institution, member of a profession or call-
ing, or any department or agency of government, in the regular
course of business or activity has kept or recorded any memorandum,
writing, entry, print, representation or combination thereof, of any
act, transaction, occurrence or event, and in the regular course of
business has caused any or all of the same to be recorded, copied or
reproduced by any photographic, photostatic, microfilm, microcard,
miniature photographic, or other process which accurately reproduces
or forms a durable medium for so reproducing the original, the
original may be destroyed in the regular course of business [unless
held in a custodial or fiduciary capacity or] unless its preservation
is required by law. Such reproduction, when satisfactorily identified,
is as admissible in evidence as the original itself in any judicial or
administrative proceeding whether the original is in existence or
not and an enlargement or facsimile of such reproduction is like-
wise admissible in evidence if the original reproduction is in exist-
ence and available for inspection under direction of the court. The
introduction of a reproduced record, enlargement or facsimile, does
not preclude admission of the original.
Sec. 2. And be it further enacted, That this Act shall take effect
June 1, 1963.

(House Bill 227)
AN ACT to add new Subsection (d) to Section 8 of Article 23 of the
Annotated Code of Maryland (1957 Edition), title "Corporations,"
subtitle "Formation of Corporations," to follow immediately after
Subsection (c) thereof; and to repeal and re-enact, with amend-
ments, Section 130 (a) (4) of said Article and Code, title "Corpora-
tions," subtitle "Recording and Filing with the State Tax Commis-
sion," allowing resident agents of domestic corporations to resign
under certain circumstances and providing for a fee CLARIFYING
PROVISIONS FOR FEES for service on State Department of
Assessments and Taxation when there is no resident agent of A
domestic corporation. AND FOREIGN CORPORATION.
