305.

[Said] The Board of Examiners shall have the power, in the exer-
cise of its sound discretion, to issue a certificate of registration,
without examination, to any applicant who has been duly registered
as a licensed practical nurse under the laws of another state, pro-
vided [said] the Board of Examiners shall determine that such
applicant possesses qualifications which are the equivalent to those
required under Section [303] 302; and provided further that such
applicant shall file a written application for registration and pay
the registration fee provided for by Section [302] 301.

Beginning in the month of January, 1957 and during the month of
January in every second year thereafter, every licensed practical
nurse registered under the provisions of this subtitle shall cause
his or her certificate to be recorded in the office of the State Board
of Examiners of Nurses, together with an affidavit, or other proof
satisfactory to [said] the Board of Examiners, of his or her identity,
as the person to whom the same was issued, and of his or her place
of residence at the time of such recordation. The registrants shall
pay to the [said] Board of Examiners a fee of two dollars ($2.00) for
each such recordation. [The existing provisions of law for the regis-
tration of certificates of licensed practical nurses in the month of
February of each year and for a registration fee of fifty cents shall
continue in effect until December 31, 1956.]

It shall be unlawful [after February 1, 1957] for any person to
practice nursing as a licensed practical nurse unless his or her
certificate has been recorded as provided in this section; provided,
however, that the failure to record such certificate shall not be cause
for the revocation by [said] the Board of Examiners of such cer-
tificate. Anyone who shall fail to re-record his or her certificate as
provided by this section shall, notwithstanding such failure to record,
remain eligible for re-recordation at any time thereafter without
examination, upon application for re-recordation and payment of the
fees therefor.

307.

This subtitle shall not be construed to affect or apply to the
gratuitous nursing of the sick [or members of the family, or shall not
prohibit anyone not a "licensed practical nurse" from nursing for
hire, provided such person shall not hold his or herself out as a
"licensed practical nurse."] by friends or members of the family, and
also it shall not apply to any person nursing the sick for hire, who
does not advertise, solicit employment or hold himself or herself out
as a licensed practical nurse.

309.

[Said] The Board of Examiners may revoke any certificate for
sufficient cause, but before this is done the holder of said certificate
shall have thirty days' notice, and after a full and fair hearing of the
charges made, by a majority vote of the whole Board, the certificate
may be revoked.
