CHAPTER 844
(House Bill 118)

AN ACT to repeal Sections 382-389, inclusive, of Article 20 of the
Code of Public Local Laws of Maryland (1930 Edition), title
"Somerset County," subtitle "Roads," subheading "Prison Labor,"
and to enact new Sections 336A to 336D, inclusive, in lieu thereof,
said new sections to follow immediately after Section 336 of said
Article and to be under the new subtitle "Prison Labor," revising
the provisions concerning the use of prison labor in Somerset
County, and relating generally to the powers of the sheriff, the
roads board, and other county and municipal officials in Somerset
County with respect to the use of prison labor.

Section 1. Be it enacted by the General Assembly of Maryland,
That Sections 382-389, inclusive, of Article 20 of the Code of Public
Local Laws of Maryland (1930 Edition), title "Somerset County,"
subtitle "Roads," subheading "Prison Labor," be and they are hereby
repealed, and that said subheading be and it is hereby repealed; and
that new Sections 336A to 336D, inclusive, be and they are hereby
enacted in lieu thereof, said new sections to follow immediately after
Section 336 of said Article, to be under the new subtitle "Prison La-
bor," and all to read as follows:

Prison Labor
336 A.

The Sheriff of Somerset County, or his jailor, upon the demand of
any incorporated town in said county, or of the Somerset County
Roads Board, or other person duly authorized to superintend the
repairing and maintenance of the public streets, and/or property of
said town, or the public roads of said county, or the beaches, parks
or any other public property in said county is authorized and re-
quired to deliver to such town, Board, person or official, any male
prisoner over sixteen years of age, who may be confined to said jail,
under sentence imposed by the Circuit Court or any Justice of the
Peace of said county in order that said town, Board, person or other
official in charge of said public streets or highways, or beaches, parks
or other public property may employ such prisoner at hard labor on
the public property of Somerset County aforesaid or of any incor-
porated town of said county.

336B.

The hard labor provided for in Section 336A shall be performed, if
within the corporate limits of any incorporated town, under the
supervision and discretion of the governing body of said town, and
if on the public roads of Somerset County, then under the direction
and supervision of the Somerset County Roads Board; and the labor
performed by such prisoners may include every service necessary for
the purpose of draining, grading, shelling, paving or repairing such
public streets or other highways of Somerset County within or with-
out the limits of any incorporated town therein.
