Edition), and Section 73-45 of the Montgomery County Code (1960
Edition), being Articles 17 and 16, respectively, of the Code of
Public Local Laws of Maryland, titles "Prince George's County"
and "Montgomery County," subtitle "Washington Suburban Sani-
tary District," as said sections were last repealed and re-enacted,
with amendments, by Chapter 742 of the Acts of the General As-
sembly of Maryland of 1961, relating to the authority of the Wash-
ington Suburban Sanitary Commission to acquire land and interests
therein by purchase or condemnation, and removing the presently
found exceptions as to the Commission's authority with respect to
land used for cemetery purposes. UNDER CERTAIN CONDI-
TIONS.
Section 1. Be it enacted by the General Assembly of Maryland,
That Section 1563 of the Code of Public Local Laws of Prince George's
County (1953 Edition), and Section 73-45 of the Montgomery County
Code (I960 Edition), being, respectively, Articles 17 and 16 of the
Code of Public Local Laws of Maryland, titles "Prince George's Coun-
ty," and "Montgomery County," subtitle "Washington Suburban
Sanitary District," as said sections were repealed and re-enacted by
Chapter 742 of the Acts of the General Assembly of Maryland of 1961,
be and they are hereby repealed and re-enacted, with amendments, to
read as follows:
1563. (73-45).
The members of said Commission shall be a body corporate
by the name of the "Washington Suburban Sanitary Commis-
sion," with the right to use a common seal, to sue and be sued, and
to do any and all other corporate acts for the purpose of carrying
out the provisions of this subtitle. In the event of a judgment at law
or in equity being recovered against said Commission or for the pur-
pose of amicably adjusting threatened or pending litigation, the
Commission shall at the annual tax levying period of the County
Council of Montgomery County and the County Commissioners of
Prince George's County next succeeding the rendition of said judg-
ment or compromise, certify to said County Council of Montgomery
County and County Commissioners of Prince George's County, a tax
rate, in addition to that required for its interest, serial bonds and
sinking fund requirements, that will, when levied and collected under
the provisions of Section 1568 (Section 73-49, Montgomery County
Code) of this subtitle, produce an amount sufficient to satisfy said
judgment or other sum including costs and counsel fees, if any, pro-
vided, however, that this provision shall relate only to any cause of
action occurring subsequent to April 26, 1927. Whenever it shall be
deemed necessary by said Commission to take or acquire any land,
structures or buildings, or any stream bed, water way, water rights,
or water shed, either in fee or as an easement, within or without the
Sanitary District, for the construction, extension or maintenance of
any water main, sewer, or appurtenance of such main or sewer, or
for any sewage disposal plant, reservoir, water purification plant,
tank or pumping station, or for the construction, extension or main-
tenance of any project it may deem necessary for carrying out the
provisions of this subtitle, said Commission may purchase the same
from the owners or failing to agree with the owner or owners thereof,
may condemn the same by proceedings in the Circuit Court for the
