(b) Every home-improvement contract subject to the provisions
of this section shall be evidenced by a written agreement and shall be
signed by the parties thereto. The writing shall contain: (1) The
name, address, and license number of the contractor, and the names
and license numbers of the salesmen who solicited or negotiated the
contract; (2) the approximate dates when the work will begin and
be substantially completed; (3) a description of the work to be done
and materials to be used; [and] (4) the agreed consideration for the
work; (5) all finance charges stated as a sum in dollars; THE NUM-
BER OF MONTHLY PAYMENTS AND THE AMOUNT OF EACH
MONTHLY PAYMENT STATED AS A SUM IN DOLLARS
WHICH SHALL INCLUDE ALL FINANCE CHARGES; and (6) a
description of any collateral security taken or to be taken for the
owner's obligation under the contract. The writing may also contain
other matters upon which the parties lawfully agree.
(c) The writing shall be legible and shall be in such form as to
clearly describe any other document which is to be incorporated [by
reference]. Before any work begins the owner shall be furnished a
copy of the written agreement, signed by the contractor.
(d) No salesman or other agent or employee of the contractor shall
be authorized to make any changes in the agreement on behalf of
the owner.
For the protection of the people of this State, the Commission
shall not grant a license to any person, nor shall it continue a license
already issued, where the Commission finds that:
(a) the person or the management personnel of the person, are
untrustworthy or not of good character; or
(b) the home-improvement transactions of the person have been
marked by a practice of failure to perform contracts, or the manipula-
tion of assets or accounts; or by fraud or bad faith.
Sec. 3. And be it further enacted, That Sections 247(d), 248, 260,
261, 265 and 268 of said Article and subtitle are hereby renumbered
and recodified, said sections to be henceforth numbered within said
Article and subtitle as follows: Section 247(d) to be numbered 248,
Section 248 to be numbered 268, Section 260 to be numbered
262, Section 261 to be numbered 265, Section 265 to be numbered 266,
and Section 268 to be numbered 269.
Sec. 4. And be it further enacted, That this Act shall take effect
June 1, 1963.
