1834                           LAWS OF MARYLAND                      [CH. 829

County in which said land, structures or buildings, stream bed, water
way, water rights, or water shed are situated, as now provided for
condemnation of land under Article 33A of the Public General Laws
of Maryland, [except that land used for cemetery purposes may not
be condemned,] and in the case of ; PROVIDED, HOWEVER, THAT
LAND USED FOR CEMETERY PURPOSES MAY NOT BE CON-
DEMNED UNTIL AND UNLESS THE COMMISSION SHALL
HAVE FIRST ADOPTED A RESOLUTION, ON THE AFFIRMA-
TIVE VOTE OF A MAJORITY OF THE COMMISSION MEMBERS
FROM THE COUNTY WHEREIN SUCH CEMETERY LAND IS
LOCATED, DECLARING THAT IT IS NECESSARY FOR THE
PUBLIC HEALTH AND SAFETY TO ACQUIRE THE SAME, OR
AN EASEMENT THEREIN, IMMEDIATELY BY CONDEMNA-
TION; AND, IN THAT EVENT, land used for cemetery purposes,
either public or private, said land or an easement therein may be
condemned provided the land or easement sought to be acquired by

the Commission does not disturb an existing grave, grave marker

or movement. IS FOR THE PURPOSE OF THE INSTALLATION
OF SEWER LINES, STORM DRAINAGE LINES OR WATER
LINES, WHICH SAID LINES SHALL BE CONSTRUCTED BE-
LOW THE SURFACE OF THE EARTH AND ENCLOSED; AND
FURTHER PROVIDED THAT THE LAND OR EASEMENT TO
BE ACQUIRED SHALL NOT DISTURB ANY EXISTING GRAVE,
GRAVE MARKER OR MONUMENT, OR ANY GRAVE SITE THE
TITLE TO WHICH HAS BEEN TRANSFERRED AS A RESULT
OF A BONA FIDE SALE OR EXCHANGE OR IN WHICH BURIAL
RIGHTS HAVE VESTED OR BEEN TRANSFERRED AS A RE-
SULT OF A BONA FIDE SALE OR EXCHANGE, and said Com-
mission may likewise condemn the interest of any tenant, lessee, or
other person having an interest in said land, structure or buildings,
stream bed, water way, water right or water shed.

Sec. 2. And be it further enacted, That this Act shall take effect
June 1, 1963.

(House Bill 466)

AN ACT to add a new Section 101 to Article 35 of the Annotated
Code of Maryland (1957 Edition and 1962 Supplement), title
"Evidence," to be under the new subtitle "Records of Health and
Mental Research," and to follow immediately after Section 100
of said Article; to add a new Section 149A to Article 43 of said
Code, title "Health," to follow immediately after Section 149 there-
of, and to be under the subtitle of "Practitioners of Medicine";
and to add a new Section 10 to Article 75C of said Code, title
"Prohibited Actions," to follow immediately after Section 9 there-
of, and to be under the new subtitle "Health and Mental Research,"
providing that certain records, reports, statements, notes and other
information which have been assembled or procured by the Medical
and Chirurgical Faculty or any of its allied medical societies or
