CHAPTER 706
(House Bill 688)

AN ACT to repeal Sections 405 to 428, inclusive, of the Code of
Public Local Laws of Harford County (1957 Edition being Article
13 of the Code of Public Local Laws of Maryland), title "Harford
County," subtitle "Metropolitan Commission," as said subtitle was
amended by Chapter 281 of the Acts of 1959, and Chapter 436 of
the Acts of 1961; and to enact in lieu thereof new Sections 405
to 427, to stand in the place of the sections so repealed; revising
the laws concerning the Metropolitan Commission of Harford
County, setting up a sanitary district under the jurisdiction of the
Harford County Metropolitan Commission, providing generally for
the members, powers and duties of this Commission and of the
Board of County Commissioners in relationship thereto, providing
that the Commission may borrow funds and under certain pro-
cedures impose benefit assessments and other charges and taxes
to repay the same; and relating generally to the Metropolitan Com-
mission of Harford County and to the operation of the sanitary dis-
trict within Harford County.

Section 1. Be it enacted by the General Assembly of Maryland,
That Sections 405 to 428, inclusive, of the Code of Public Local Laws
of Harford County (1957 Edition, being Article 13 of the Code of
Public Local Laws of Maryland), title "Harford County," subtitle
"Metropolitan Commission," as said subtitle was amended by Chapter
281 of the Acts of 1959, and Chapter 436 of the Acts of 1961, be and
they are hereby repealed and new Sections 405 to 427 be and they are
hereby enacted, to stand in the place of the sections so repealed; all to
read as follows:

405. Commission; qualification, organization, bonds.

(a) For the purpose of carrying out the provisions of this subtitle,
the sanitary district created hereafter is under the jurisdiction of a
Commission of five persons, all of whom shall be appointed by the
County Commissioners of Harford County, and all of whom shall
reside in Harford County, be resident taxpayers of said County and
qualified voters thereof. The members of the Commission shall re-
ceive such compensation as may be determined by the County Com-
missioners from time to time. The term of each of the five members
is five years or until their successors are appointed and have quali-
fied, except that the first Commissioner named by said Commissioners
shall serve for one year, the second shall serve for two years, and
the third shall serve for three years, the fourth for four years and
the fifth for five years from the dates of their respective appoint-
ments; and as the term of each Commissioner expires, his successor
shall be appointed by the County Commissioners. Any vacancy in the
membership of the Commission shall be filled by appointment by the
County Commissioners for the unexpired term. The members of the
Commission are a body corporate by the name of the "Harford
County Metropolitan Commission" (referred to elsewhere in this
subtitle as "the Commission"), with the right to use a common seal,
to sue and be sued, and to do any and all other corporate acts for the
purpose of carrying out the provisions of this subtitle. Nothing in
this section shall be construed to affect the rights and liabilities of
