Laws of Maryland), title "Montgomery County," subtitle "Li-
censing and Regulation," to follow immediately after Section
15-5 thereof, providing for the definition and general regulation
in Montgomery County of limousines and their owners and opera-
tors by the County Council of Montgomery County, and providing
for the regulation and fixing of rates in Montgomery County to
be charged for the transportation of passengers by said limou-
sines and their owners and operators, by the County Council of
Montgomery County.
Section 1. Be it enacted by the General Assembly of Maryland,
That new Sections 15-5.1 and 15-5.2 be and they are hereby added
to the Montgomery County Code (1960 Edition, being Article 16 of
the Public Local Laws of Maryland), title "Montgomery County,"
subtitle "Licensing and Regulation," to follow immediately after
Section 15-5 thereof, and to read as follows:
15-5.1.
The term "limousine" as used in this and the following section
shall embrace any motor vehicle for hire, designed to carry eight
or nine persons, including the driver, operated upon any public street
or highway in the County, or, on call or demand, accepting or solicit-
ing passengers indiscriminately for transportation for hire between
such points along public streets or highways in this state, as may
be directed by the passenger so being transported; provided that
nothing in this Chapter shall be construed to include as a limousine,
a motor vehicle operated, with the approval of THE WASHINGTON
METROPOLITAN AREA TRANSIT COMMISSION OR the Public
Service Commission, on fixed routes and schedules, NOR TO IN-
CLUDE AS A LIMOUSINE, A MOTOR VEHICLE OPERATED BY
ANY FUNERAL DIRECTOR DULY LICENSED BY THE STATE
BOARD OF FUNERAL DIRECTORS AND EMBALMERS OF
MARYLAND, OR ANY FUNERAL LIVERY SERVICE LICENSED
AS SUCH BY THE DEPARTMENT OF MOTOR VEHICLES OF
MARYLAND, WHILE SAID VEHICLE IS BEING OPERATED
FOR THE PURPOSE OF FUNERAL DIRECTION, FUNERAL
SERVICES, AND TRANSPORTATION INCIDENTAL THERETO.
15-5.2.
In order to protect the public health, safety and welfare of the
citizens of the county and other persons who may use limousine facili-
ties therein, the County Council is hereby authorized and empowered
to enact, amend and repeal ordinances providing for the regulation
of limousine rates in the County, regulations for the ownership and
operation of limousines in the County, and to provide for and fix the
requirements for the registration, licensing and inspection of limou-
sines, their owners and operators. The regulations herein provided
for such vehicles in the County shall be in addition to any regula-
tions by the commissioner of motor vehicles of Maryland, THE
WASHINGTON METROPOLITAN AREA TRANSIT COMMIS-
SION or the Public Service Commission of Maryland.
Sec. 2. And be it further enacted, That this Act shall take effect
June 1, 1963.
