(House Bill 421)
AN ACT to add a new Section 34 to Article 15A of the Annotated
Code of Maryland (1957 Edition), title "Budget and Procurement,"
subtitle "Purchasing Bureau," to follow immediately after Section
33 thereof, relating to the purchases and the purchasing program
of certain departments, boards, commissions, offices, courts,
bureaus, or other agencies of the State government, PROVIDING
THAT ANY SUCH DEPARTMENT, BOARD, COMMISSION,
OFFICE, BUREAU OR OTHER AGENCY SHALL BE SUBJECT
TO THE PURCHASING LAWS AND REGULATIONS OF THE
POLITICAL SUBDIVISION, and providing for the effect of this
act upon the Police Department of Baltimore City.
Section 1. Be it enacted by the General Assembly of Maryland,
That new Section 34 be and it is hereby added to Article 15A of the
Annotated Code of Maryland (1957 Edition), title "Budget and Pro-
curement," subtitle "Purchasing Bureau," to follow immediately
after Section 33 thereof, and to read as follows:
34.
A department, board, commission, office, court, bureau, or other
agency of the State government which receives more than one-half
of its regular annual operating expenses from a political subdivision
of this State is not a "using authority" within the meaning of this
subtitle; and the Department of Budget and Procurement and the
Purchasing Bureau are not required to make any purchases for or
take any part in the purchasing program of any such department,
board, commission, office, court, bureau, or other agency. As
to any such department, board, commission, office, court, bureau, or
other agency, the political subdivision from which it receives more
than one-half of its regular annual operating expenses has the SHALL
HEREAFTER HAVE THE responsibility for operating the purchas-
ing program; AND ANY SUCH DEPARTMENT, BOARD, COM-
MISSION, OFFICE, BUREAU OR OTHER AGENCY SHALL BE
SUBJECT TO THE PURCHASING LAWS AND REGULATIONS
OF SUCH POLITICAL SUBDIVISION NOW OR HEREAFTER IN
EFFECT. Nothing in this section shall be construed or applied to
OTHERWISE alter the Public Local Laws of Baltimore City with
respect to the Police Department of Baltimore City.
Sec. 2. And be it further enacted, That this Act shall take effect
June 1, 1963.
