Guard and naval militia. Each of them may receive an appointment as
aide, which however, shall not add to the actual grade of the officer
so appointed; nor shall such officer be relieved from duty with the
organization to which he is assigned, except when actually on duty
as aide under the orders of the Governor.
The appointment of a chief of staff and of aides shall be at the
pleasure of the Governor.
Sec. 2. And be it further enacted, That this Act shall take effect
June 1, 1963.

AN ACT to repeal and re-enact with amendments Section 243 of
Article 77 of the Annotated Code of Maryland (1957 Edition), title
"Public Education" subtitle "Chapter 24. Pre-school Education of
Handicapped Children," amending the laws concerning the annual
appropriation for special education and training of handicapped
children under six years of age in order to remove therefrom a
specification as to the minimum amount of such appropriation.
Section 1. Be it enacted by the General Assembly of Maryland,
That Section 243 of Article 77 of the Annotated Code of Maryland
(1957 Edition), title "Public Education," subtitle "Chapter 24. Pre-
school Education of Handicapped Children," be and the same is hereby
repealed and re-enacted with amendments to read as follows:

The Governor shall place in the State budget each year an item
for the education and training of handicapped children under six
years of age. [The amount shall be in his discretion, except that it
shall not be less than two hundred and fifty thousand dollars ($250,-
000) annually.] The appropriation as finally determined by the Gen-
eral Assembly shall be expended under the supervision and control of
the State Department of Education. For the purposes of this pro-
gram, a handicapped child shall be one with a physical impairment or
mental retardation which, in the judgment of the Department, makes
a special educational and training program necessary or desirable to
help the child attain a scholastic achievement as near normal as
feasible. The Department of Education shall adopt standards and
promulgate rules and regulations based thereon, for the nonmedical
examination, classification and education of such handicapped chil-
dren, for the qualifications of teachers, for curriculum and equipment,
and generally for the supervision and operation of the program herein
provided for.
Sec. 2. And be it further enacted, That this Act is hereby declared
to be an emergency measure and necessary for the immediate pres-
ervation of the public health and safety, and having been passed by
a yea and nay vote supported by three-fifths of the members elected
