whose name is thereby TO BE entered on the ballot; and if the cost
is not paid, the name of the nominee shall not be printed on the
ballot; provided, however, that the provisions of this section shall
not apply to nominating petitions for election to membership on the
County Board of Education for Montgomery County.
Sec. 2. And be it further enacted, That this Act shall take effect
June 1, 1963.

(Senate Bill 554)
AN ACT to repeal and re-enact, with amendments, Section 119 (d)
of Article 52 of the Annotated Code of Maryland (1957 Edition),
title "Justices of the Peace", sub-title "Trial Magistrates System",
relating to substitute magistrates in Allegany County, requiring
the payment of such magistrate's salary, when sitting to be paid
by the magistrate causing the substitution for any period in
excess of five days.; AND RELATING TO THE DETAILS OF
SUCH PAYMENTS.
Section 1. Be it enacted by the General Assembly of Maryland,
That Section 119 (d) of Article 52 of the Annotated Code of Mary-
land (1957 Edition), title "Justices of the Peace", sub-title "Trial
Magistrates System", be and it is hereby repealed and re-enacted,
with amendments, to read as follows:
119.
(d) In the event of the temporary absence or inability of a trial
magistrate, the substitute trial magistrate shall serve in his place
and stead during the period of his absence or inability, and shall
have the same power and authority and be subject to the same duties
and responsibilities as the said trial magistrate. He shall receive
from the county commissioners the same pro rata amount for his
compensation and the same expenses as would have been received
under this sub-title by the trial magistrate whose absence or inabil-
ity caused the substitution, and the salary of the trial magistrate so
causing the substitution, shall be diminished by a sum necessary to
compensate the substitute as herein provided, for any such period of
absence or inability in excess of 15 days (5 days in Allegany
County) in any one year.; BUT IN ALLEGANY COUNTY THE
SALARY OF A TRIAL MAGISTRATE SHALL NOT BE RE-
DUCED FOR ANY PERIOD OF HIS ABSENCE ON A REGU-
LARLY SCHEDULED VACATION AS AUTHORIZED BY THE
COUNTY COMMISSIONERS FROM TIME TO TIME.
Sec. 2. And be it further enacted, That this Act shall take effect
June 1, 1963.
