titioners of Medicine", to follow immediately after Section 149
thereof, providing that certain physicians who, in good faith,
render medical aid, care not in a hospital, and assistance for which
the physician receives no compensation, at the scene of an accident,
shall not be liable for civil damages as result of any professional
acts, not amounting to gross negligence, in rendering such aid, and
establishing a defense against any action, not amounting to gross
negligence, for negligence brought against him on such facts.
Section 1. Be it enacted by the General Assembly of Maryland,
That a new Section 149A be and it is hereby added to Article 43 of
the Annotated Code of Maryland (1957 Edition), title "Health",
sub-title "Practitioners of Medicine", to follow immediately after
Section 149 thereof, and to read as follows:
149A. Liability for civil damages.
A physician licensed to practice medicine by the Board of Medical
Examiners of the State of Maryland, who, in good faith, renders
medical aid, care, not in a hospital, and assistance for which the
physician received no fee or compensation, at the scene of an accident,
shall not be liable for any civil damages as the result of any profes-
sional acts or omissions by him, not amounting to gross negligence,
in rendering such aid, care, and assistance. The physician shall have
a defense against any action, not amounting to gross negligence, for
negligence or malpractice brought against him because of any pro-
fessional acts or omissions in the rendering of such care, aid and
assistance.
Sec. 2. And be it further enacted, That this Act shall take effect
June 1, 1963.

(Senate Bill 119)
AN ACT to add a new Section 149A to Article 43 of the Annotated
Code of Maryland (1957 Edition), title "Health", sub-title "Prac-
titioners of Medicine" to follow immediately after Section 149
thereof, and to provide that no person other than a duly licensed
medical physician or dentist shall hold himself out as being able
to prescribe treatment for or cure the disease of cancer or sell or
offer to sell or give away, except upon the prescription of a duly
licensed medical physician or dentist, any drug, medicine, com-
pound, nostrum or device which is represented by the manufacturer
or seller to have curative powers when used in the treatment of the
disease of cancer and that this act should not be construed to im-
pose any limitation upon the free exercise of religion in this State
and providing a penalty for violating the provisions of this act.
