So the enacting clause was stricken out.
The bill entitled, an act to authorise the Mayor and City
Council of Baltimore to establish and enforce an inspection of
gas and gas metres in that city,
Being upon its second reading,
Mr. Crowley proposed the following as a substitute for the
3d section thereof:
"Sec. 3. Be it enacted, by the General Assembly of Mary-
land, That such deficiency in the quality of said gas, or such
defectiveness of any metre, or measure, as referred to above,
shall not subject the Gas Light Company of Baltimore to the
operation of this act; unless such deficiency in the quality of
said gas, or such defectiveness of any metre or measure, shall
be justly chargeable to a design or a neglect, on the part of
any agent or agents of said company; and no penalty shall in
any way attach to said Gas Light Company of Baltimore, un-
til such charge of a design, or neglect, or such defectiveness of
any metre or measure shall first have been legally estab-
lished;"
