232              JOURNAL OF PROCEEDINGS [Feb. 3,

not find, after carefully examining the subject, that any pub-
lic convenience or necessity requires that such an act should
be passed, nor, inasmuch as there is at this time an application
from the same parties for a road, before the County Commis-
sioners of Baltimore county, to be opened over the route pro-
posed by these memorialists, and for nearly the same length
(which application is. now pending before those Commission-
ers, and is not yet adjudicated by them,) we are of opinion
that the County Commissioners of Baltimore county, should
first decide upon the aforesaid application as to whether the
public convenience or necessity would require them to grant
the same, before this Legislature can properly be called upon
to exercise their highest power—the right of eminent domain
—we recommend that the prayer of the memorialists be not
granted.
