of the act entitled, an act for the promotion of internal im-
provements, passed at December session, 1835, chapter 395;
Said bill being upon its second reading.
Mr. Freaner proposed the following amendment:
And provided further, That the sum of three hundred and
fifty thousand dollars be and the same is hereby appropria-
ted to works of internal improvement in "Washington county,
in lieu and payment of the forfeit of one million of dollars by
the Baltimore and Ohio Railroad company, of which said for-
feit the said company was absolved by act of Assembly, 1840,
chapter 260, without any compensation whatever to said
county, and that the said sum is hereby appropriated to the
Washington county Railroad company; and as soon as it
shall appear to the Governor, by the affidavit of the President
of said company, that bona fide subscriptions to the capital
stock of said company to the amount of one hundred thou-
sand dollars shall have actually been made, the Treasurer
of the State, shall be and is hereby authorised and required
in the name and on behalf of the State, to subscribe for so
many shares of the capital stock of said company, as shall
amount to the sum of three hundred and fifty thousand dol-
lars; and the said Treasurer shall, out of any unappropriated
money in the Treasury, pay the instalments on each share of
the capital stock of said Washington County Railroad com-
pany, for which he may subscribe as aforesaid, on the war-
rant of the Comptroller, which the latter officer is hereby
directed to issue as said instalments may be called for, agree-
ably to the provisions of the act incorporating said company.
And provided further, That the Treasurer shall not pay more
than one-half of the said sum of three hundred and fifty
thousand dollars in any one year, anything in this act to the
contrary notwithstanding.
