On motion of Mr. Tower,

The said bill was reconsidered to the second reading, to enable
him to offer the following substitute:                         

An Act to erect the Town of Cumberland into a City, and for
other purposes.

Section 1. Be it enacted by the General Assembly of Mary-
land, That the Town of Cumberland, in the county of Allegany,
shall be and the same is hereby erected into a city, by the name
of the city of Cumberland, and the inhabitants thereof constituted
a body politic and corporate by the name of the Mayor and Coun-
cil of the city of Cumberland, and as such shall have perpetual
succession, and by their corporate name may sue and be sued,
implead and be impleaded in all Courts of law or equity; grant,
receive, and do all other acts as natural persons, and may purchase
and hold real, personal, and mixed property, or dispose of the
same for the benefit of said city, and may have and use a city seal,
which may be altered or changed at pleasure; and shall have and
exercise all the powers and authority now exercised and vested
by law in the Mayor and Councilmen of the town of Cumberland,
by any and all Acts of Assembly of this State heretofore passed
and now in force relating to the powers and duties of the corpo-
rate authorities of said town under and by virtue of the said acts
of Assembly incorporating said town, and relating to its govern-
ments, and all powers granted by this act and by any future act
of Assembly of this State.

Sec. 2. And be it enacted, That all Acts of Assembly of this
State now in force and ordinances heretofore passed under
the same by the Mayor and Councilmen of the town of Cumber-
land and now in force relative to the said town of Cumberland,
and not inconsistent with the provisions of this act shall continue
and be in force until the same may be altered or repealed by the
proper authority, and that all rights existing under and by virtue of
the present Acts of Assembly of this State and of the ordinances,
rules and regulations heretofore passed, or adopted by the said
corporate authorities of said town, shall continue to be in force in
the same manner as if this Act had not been passed, except so
far as they are modified or changed by this Act.

Sec. 3. And be it enacted, That the government of said City
shall be managed by a Mayor and six Councilmen who shall be
elected as now provided by law and whose powers and duties
shall be the same as are now prescribed by the laws and ordinan-
