poultry, fowl, or other animals used in furtherance of farming activi-
ties, providing further that the provisions of this sub-title shall not
apply to the sale or offering for sale, or distribution of seeds, feed
for livestock and poultry, fertilizers, lime, land plaster, fungicides
and insecticides, nor to apply to any drug which on June 1, 1961,
may be sold without a prescription.
Sec. 2. And be it further enacted, That this Act shall take effect
June 1, 1961.

CHAPTER 591
(House Bill 7)
AN ACT to repeal and re-enact, with amendments, Section 3 of
Article 64A of the Annotated Code of Maryland (1960 Supple-
ment), title "Merit System", and to repeal and re-enact, with
amendments, Section 5 of Article 66½ of said Code (1957 Edi-
tion), title "Motor Vehicles", sub-title "Administration—Regis-
tration—Titling", providing that the office of the Commissioner
of Motor Vehicles shall be included in the classified service, or
merit system, of this State, and making provision for the inclusion
therein of the incumbent Commissioner as of June 1, 1961; and
repealing all laws and parts of laws and all regulations and parts
of regulations promulgated and adopted by any department or
agency of the State government, which are inconsistent with the
provisions of this Act.
Section 1. Be it enacted by the General Assembly of Maryland,
That Section 3 of Article 64A of the Annotated Code of Maryland
(1960 Supplement), title "Merit System", be and it is hereby repealed
and re-enacted with amendments; and that Section 5 of Article 66½
of said Code (1957 Edition), title "Motor Vehicles", sub-title "Ad-
ministration—Registration—Titling", be and it is hereby repealed
and re-enacted, with amendments, to read as follows:
ARTICLE 64A
3. Positions excluded from system—Enumeration.
The following positions shall not be included in the classified serv-
ice, namely: Those held by officers elected by popular vote and of-
ficers whose appointment and election is provided by the Constitution,
including deputy clerks provided for by the Constitution, Article 4,
Sections 26 and 37; officers and employees of the General Assembly
or of either house thereof; officers and employees appointed or
designated by any court or judge thereof; deputies, assistants and
employees appointed or designated by any sheriff, any register of
