of this section the employee in question shall be paid during the
remainder of his natural life a salary or pension, payable monthly,
equal to fifty percent (50%) of his annual remuneration, said annual
remuneration to be taken as of the year immediately preceding the
granting of his application for retirement. No money payable under
this sub-title shall, prior to issuance and delivery of the warrant or
voucher therefor, be capable of being assigned, charged or taken in
execution or attachment. All employees subject to the provisions of
this subtitle shall contribute to the pension fund, hereinafter pro-
vided for, a sum equal to the contribution which such employees
would have paid to the State Police Retirement System for all bene-
fits thereunder had they elected to become members thereof. The
amount of the contribution of each of the employees subject to the
provisions of this subtitle shall be fixed annually in advance by the
board of trustees of the retirement and pension system of the Mary-?
land State Police and shall be deducted monthly from the remunera-
tion of the said employees and paid in lieu thereof to the said board
to be placed by it forthwith in said pension fund. The said fund
shall also consist of all fines imposed upon members of the Maryland
State Police by way of discipline, donations, all lost, abandoned,
unclaimed or stolen money, which may remain in the possession of
said Department for the space of three years and for which there
shall be no lawful claimant, and net proceeds of sale of unclaimed
property in the custody of said Department.

(b)   For the purpose of determining the fifteen years of continuous
meritorious service rendered by any of the employees of said De-
partment, transferred thereto from the Commissioner of Motor
Vehicles, or by any of the license examiners of the Commissioner of
Motor Vehicles, the years of service shall include those rendered to
said Commissioner and/or to said Department as the case may be.

53. Benefits.

(1) Service retirement benefit, (a) Any member in service may
retire upon written application to the board of trustees setting forth
at what time, not less than thirty days nor more than ninety days
subsequent to the execution and filing thereof, he desires to be retired,
provided that such member at the time so specified for his retirement
shall have attained the age of fifty-five and notwithstanding that
during such period of notification he may have separated from serv-
ice, excepting the physician of the Department who shall have at-
tained the age of 65 at the time specified for his retirement.

(c)   Any member in service who has attained the age of sixty-four
shall be retired on the first day of the next calendar month after
attaining such age, excepting the physician of the Department who
shall be retired on the 1st day of the next calendar month after
attaining the age of 70.

Sec. 2. And be it further enacted. That this Act shall take effect
June 1, 1961.
