CHAPTER 478
(House Bill 56)

AN ACT to repeal and re-enact, with amendments, sub-section (j)
of Section 265 of Article 66C of the Annotated Code of Maryland
(1957 Edition), title "Natural Resources", sub-title "Fish and
Fisheries", sub-heading "Part 2. Tidal Waters", amending a pro-
vision in the Fishery laws which concerns fishing with a haul
seine and also repealing a special provision concerning the effect
of this sub-section in Worcester County.

Section 1. Be it enacted by the General Assembly of Maryland,
That sub-section (j) of Section 265 of Article 66C of the Annotated
Code of Maryland (1957 Edition), title "Natural Resources", sub-
title "Fish and Fisheries", sub-heading "Part 2. Tidal Waters", be
and it is hereby repealed and re-enacted, with amendments, to read
as follows:

265.

(j) Haul seines not to be used during week ends [in certain
waters].—It shall be unlawful for any person to fish with a haul
seine during the period from Friday midnight until sunup on Mon-
day in the tidal waters of this State [, except that this restriction
shall not apply in the waters of the Chesapeake Bay north of the
Chesapeake Bay Bridge or in the tributaries of the Chesapeake Bay
if any such waters are designated as restricted areas by the United
States Government]. Any person found guilty of fishing or taking
fish with a haul seine during the period prohibited under this sub-
section shall be guilty of a misdemeanor and upon conviction thereof
shall be fined not less than $100.00 nor more than $500.00 and shall
stand committed in the Baltimore City jail or to the county jail until
such fines and costs are paid; and all boats, nets, seines or other
equipment used for the purpose of violating the provisions of this
subsection shall be declared forfeited, and said fine and forfeiture
shall be disposed of as provided under the provisions of this article.
[Provided, however, that the provisions of this subsection shall not
apply in Worcester County.]

Sec. 2. And be it further enacted, That this Act shall take effect
June 1,1961.

CHAPTER 479
(House Bill 65)

AN ACT to add a new Section 304A to Article 66C of the Annotated
Code of Maryland (1957 Edition), title "Natural Resources", sub-
title "Fish and Fisheries", sub-heading "Part 2. Tidal Waters", to
follow immediately after Section 304 thereof to provide for trans-
fer of licenses from one type of fishing equipment to another under
rules and regulations to be provided by the Department of Tide-
water Fisheries.
