vided for in this sub-title. Said designation shall be plainly and
conspicuously shown in connection with said sale or offer for sale
and shall be shown on the container, and in the offer to sell, and, if
loose, by a sign placed on or near such eggs. Any eggs not designated
as Grade B or Grade C shall be presumed to be Grade A, in allowing
tolerance for quality.
164.
Two eggs in any dozen AT THE RETAIL LEVEL or ten per cent
by count of the eggs in a case, AT THE WHOLESALE LEVEL, not
having serious defects, as shall be defined in the rules and regulations
promulgated hereunder, may be below the designated quality or size;
but the sum of said eggs below the designated size and quality shall
not exceed two eggs in any dozen AT THE RETAIL LEVEL or ten
percent by count of the eggs in any case of eggs. AT THE WHOLE-
SALE LEVEL.
165.
No person shall sell shell eggs to a retailer, unless at the time of
delivery he shall furnish to such retailer an invoice DELIVERY
TICKET accurately detailing, as herein provided, the sale of such
shell eggs. Every invoice DELIVERY TICKET shall contain upon
its face the following information: (1) date of delivery; (2) name and
address of the seller; (3) name and address of the purchaser; (4) the
quantity; (5) the price; and (6) AND (5) the grade and size of the
shell eggs delivered.
166.
The State Board of Agriculture is authorized to promulgate a
special grade or special grades of eggs of a standard superior to
grade A eggs for use on a voluntary basis for eggs produced in
Maryland. In connection therewith, said Board is authorized by rule
or regulation (1) to prescribe and define quality and size standards,
and establish special tolerances, for such grade or grades of eggs,
(2) to require, as a condition precedent to sale, that any person de-
siring to pack such special grade or grades for sale register annually
with the Board and pay reasonable registration fees therefor, as may
be determined by the Board, (3) to devise and charge reasonable fees
for seals or other appropriate identifying insignia to be used, as a
condition precendent to sale of such special grade or grades, by any
person desiring to pack same for sale, and (4) to promulgate such
other rules and regulations as may be necessary to effectuate the
purposes of this section. In addition to the penalties provided in
Section 166B of this sub-title, the Board may revoke the registration
of any person who violates any of the provisions of this sub-title,
or of any rule or regulation lawfully promulgated in pursuance
thereof.

The Maryland State Board of Agriculture through its duly ap-
pointed agents and enforcing officers, is hereby authorized, directed
and empowered to enforce the provisions of this sub-title, and shall
have the power to define, promulgate and enforce such reasonable
