sub-title "Eggs", and to enact twelve ELEVEN new Sections to
stand in the place and stead of the Sections so repealed, said new
sections to be known as Sections 160-166D, inclusive, and to stand
in the place of the sections so repealed, relating to the sale of shell
eggs in this state, and establishing grading, quality, size and weight
standards therefor; prohibiting the sale of eggs failing to meet
such standards; imposing marking, labeling and invoice require-
ments with respect to such sale; and making provision for the
promulgation of a special grade or grades of eggs and for con-
ditions relating to the sale thereof; and providing for enforce-
ment of the Act and imposing penalties for violation of the pro-
visions thereof.
Section 1. Be it enacted by the General Assembly of Maryland,
That Sections 160-166, inclusive, of Article 48 of the Annotated Code
of Maryland (1957 Edition), title "Inspections", sub-title "Eggs",
be and they are hereby repealed; and new Sections 160-166D, in-
clusive, are hereby enacted, to stand in the place of the Sections so
repealed and to read as follows:
160.
No person shall sell, offer, or expose for sale, advertise or in any
manner represent for sale shell eggs to a retailer or consumer un-
less such shell eggs shall meet a standard of quality, a grade and
size (weight) classification, as provided for in this sub-title.
161.
The Maryland standard for quality of individual shell eggs shall
be the same as the United States Department of Agriculture Stand-
ard of AA quality, A quality, B quality and C quality. The Mary-
land consumer grades for shell eggs shall be Grade AA, Grade A,
Grade B and Grade C, except as provided in Section 166A 166 of this
sub-title. No descriptive term or terms other than the applicable
grade and size designations, shall be used when eggs are offered
for sale, exposed for sale, sold or advertised, except the descriptive
term "Fresh", and for eggs produced in Maryland, the term "Mary-
land, Fresh" may be used in addition to the applicable grade and size
designation; provided further that terms "Fresh" and "Maryland
Fresh" may not be used for eggs below A quality. Final deter-
minations as to meeting the standard of quality for shell eggs shall
be made by candling.
162.
The size (or weight) classification for individual shell eggs in
Maryland shall be the same as official United States Department
of Agriculture Weight Classes for shell eggs for the following
classifications: Jumbo, Extra Large, Large, Medium, and Small
provided that shell eggs not classified as to size must be designated
as unclassified in lieu of a size classification. Weights as permitted
in this sub-title shall be net weight and shall not include the weight
of any container.

No person shall sell or offer to sell, or deliver any shell eggs not
properly designated in respect to quality and size standard, as pro-
