CHAPTER 411

(Senate Bill 437)

AN ACT to add new Sections 387A and 387B to Article 43 of the
Annotated Code of Maryland (1957 Edition), title "Health", sub-
title "Water, Ice, and Sewage", SEWERAGE", to follow immedi-
ately after Section 387 thereof, providing that the State Board
of Health shall be charged with assisting the development of com-
prehensive master plans for the construction of basic sewerage sys-
tems and further providing a method of assisting counties and
municipalities in the construction thereof.

Section 1. Be it enacted by the General Assembly of Maryland,
That new Sections 387A and 387B be and they are hereby added to
Article 43 of the Annotated Code of Maryland (1957 Edition), title
"Health", sub-title "Water, Ice, and Sewage", SEWERAGE", said
new sections to follow immediately after Section 387 thereof, and to
read as follows:

387A. The State Board of Health shall be charged with the duty
of assisting the counties and municipalities of the State in develop-
ing comprehensive master plans for the construction of the basic
main facilities of sewerage systems for the collection and disposal of
sewage and industrial wastes from lateral or collector sewers. The
term "basic main facilities" shall be construed to include sewage
treatment plants, intercepting sewers, outfall sewers, pumping star-
tions and force mains connected therewith, as distinguished from
lateral or collector pipes serving specific properties or developments.
The Board shall endeavor in the development of the master plans of
the several counties and municipalities of the State and in its
approval of the construction of sanitary facilities, pursuant to its
powers under this sub-title, to coordinate plans upon a regional basis
in those cases in which regional planning is deemed advisable.
IN
THOSE AREAS OF PRINCE GEORGE'S COUNTY AND MONT-
GOMERY COUNTY UNDER THE JURISDICTION AND AU-
THORITY OF THE WASHINGTON SUBURBAN SANITARY
COMMISSION WITH RESPECT TO WATER AND SEWERAGE
FACILITIES, THE PROVISIONS OF THIS SECTION RELATING
TO COUNTIES, MUNICIPALITIES/OR ANY AGENCY THERE-
OF, SHALL INCLUDE THE WASHINGTON SUBURBAN SANI-
TARY COMMISSION, AND WITH RESPECT TO SAID COMMIS-
SION THE AUTHORITY GRANTED HEREBY SHALL BE IN
ADDITION TO, BUT NOT IN DEROGATION OF, THE AUTHOR-
ITY GRANTED BY ANY OTHER ACT OF THE GENERAL AS-
SEMBLY OF MARYLAND.

387B. (a) A Sanitary Facilities Construction Fund is hereby
established, and it shall consist of such funds as are provided in the
State's annual budget. The fund shall be available to the Board, both
to finance local planning for sewage facilities upon an equal match-
ing basis with counties, municipalities
