increase in compensation shall take effect at the beginning of the
term of the Sheriff of Allegany County who is elected to that office at
the regular elections in the month of November, 1962.
Sec. 3. And be it further enacted, That this Act shall take effect
June 1, 1961.

CHAPTER 45
(Senate Bill 107)
AN ACT to repeal Sections 42 and 43 of Article 24 of the Code of
Public Local Laws of Maryland (1930 Edition), title "Worcester
County", sub-title "Berlin"; to repeal Sections 64, 65, 66, 67 and 68
of said article, sub-title "County Commissioners"; to repeal Sec-
tions 226 and 227 of said article, sub-title "Pocomoke City"; and
to repeal Sections 325 and 326 of said article, sub-title "Snow Hill",
repealing certain local laws of Worcester County which concern
payments by the County Commissioners of Worcester County to
the political sub-divisions of Berlin, Ocean City, Pocomoke City and
Snow Hill of a portion of the road and bridge taxes levied and col-
lected by the County Commissioners; and relating generally to
road and bridge taxes and to the repair, maintenance and improve-
ment of streets, roads and bridges within certain portions of Wor-
cester County.
Whereas, The local laws of Worcester County contain a number of
sections which relate to the payment by the County Commissioners
to several political sub-divisions within the county of a portion of
the road and bridge taxes levied and collected by the County Com-
missioners; and
Whereas, The State Law Department in a letter dated December
29, 1959 and addressed to the Senator from Worcester County has
ruled that these sections may be repealed despite the fact that some
of them were codified as portions of municipal charters in the 1930
Edition of the Code of Public Local Laws of Maryland; and despite
the fact that it might be claimed these sections relate to the "govern-
ment or affairs" of the several municipal corporations within the
provisions of Section 1 of Article HE of the Constitution of Mary-
land; and
Whereas, In its ruling the Law Department held that these sections
do not relate strictly to the government and affairs of the several
municipal corporations and that they are not within the contempla-
tion of Article HE of the Constitution and therefore may be repealed
by the General Assembly; now, therefore
