clams by hand scrape(s) and/or Shinnecock rakes shall make appli-
cation to the Department of Tidewater Fisheries for a Clam Hand
Scrape License. Each applicant shall submit the name or number of
the boat, any other information which may be required by the De-
partment of Tidewater Fisheries and must have been a resident of
Worcester County for one year prior to making application for a
Clam Hand Scrape License. EVERY SUCH APPLICANT SHALL
EXHIBIT TO SAID DEPARTMENT SATISFACTORY EVIDENCE
SHOWING THE NAME OR NUMBER AND SIZE OF THE BOAT,
MAKE OATH OR AFFIRMATION THAT HE IS THE BONA
FIDE OWNER OF SUCH BOAT; THAT THERE IS NO LIEN ON
SAID BOAT HELD BY A NONRESIDENT OF MARYLAND;
THAT HE HAS BEEN A RESIDENT OF WORCESTER COUNTY
FOR AT LEAST ONE YEAR PRIOR TO THE MAKING OF SUCH
APPLICATION AND ANY OTHER INFORMATION WHICH
MAY BE REQUIRED BY THE DEPARTMENT.
(3) Upon the receipt of such application and a fee of $10.00 the
Department of Tidewater Fisheries shall issue a Clam Hand Scrape
License.
(4) The Commission of Tidewater Fisheries is hereby empowered
to make rules and regulations and to modify the same from time to
time, to regulate the type, number and sizes of hand scrapes and
Shinnecock rakes which may be used.
(5) It shall be unlawful to take or catch clams between sunset and
sunrise or on Sundays.
(6) It shall be unlawful to take or catch clams by hand scrape
and/or Shinnecock rake in Worcester County except from October 1
in each year to April 30, both dates inclusive.
(7) The Captain or Master of any boat licensed to take clams
with a hand scrape or Shinnecock rake shall have such license on
board his boat and shall exhibit the same whenever it shall be re-
quested by any duly authorized officer or employee of the Depart-
ment of Tidewater Fisheries. EACH PERSON WHEN WORKING
ON SUCH BOAT SHALL HAVE IN HIS POSSESSION A LI-
CENSE ISSUED TO HIM AS REQUIRED IN PARAGRAPH (A)
OF THIS SECTION.
(8) The Commission of Tidewater Fisheries is authorized to re-
voke, or suspend for periods of not less than ten (10) days, any
Hand Scrape and Shinnecock Rake License, after due hearing upon
not less than ten (10) days notice to the licensee, upon the following
grounds: (1) The making of any materially false statement in the
application for such license; (2) the conviction of the licensee of any
violation of the provisions of this sub-section. It shall be unlawful
for any licensee to take or catch hard shell clams with Shinnecock
rake or clam dredge, or similar device, during the period within
which his license is suspended or revoked.
(9) Any person violating any provision of this sub-section shall
be deemed guilty of a misdemeanor and upon conviction thereof shall
be fined not less than Fifty Dollars ($50.00) nor more than Five
Hundred Dollars ($500.00), or be imprisoned in the House of Correc-
tion not more than six months, or be both fined and imprisoned at
the discretion of the Court; and any boat used in any such violation
may be seized by the Department of Tidewater Fisheries and held
