CHAPTER 244
(House Bill 403)

AN ACT to add new Section 23A to the Code of Public Local Laws
of Wicomico County (1959 Edition, being Article 23 of the Code
of Public Local Laws of Maryland), title "Wicomico County", sub-
title "County Commissioners", to follow immediately after Section
23 thereof, authorizing the County Commissioners of Wicomico
County to adopt and promulgate and from time to time to amend,
revise, rescind or change a building code for the County, to enforce
and administer the code, and to provide penalties for violations.

Section 1. Be it enacted by the General Assembly of Maryland,
That a new Section 23A be and it is hereby added to the Code of
Public Local Laws of Wicomico County (1959 Edition, being Article
23 of the Code of Public Local Laws of Maryland), title "Wicomico
County", sub-title "County Commissioners", to follow immediately
after Section 23 thereof, and to read as follows:

23A. The County Commissioners of Wicomico County are author-
ized to adopt and promulgate, and from time to time to amend, revise,
rescind or change, a building code, to provide for the construction,
maintenance and repair of any and all buildings and structures
located within the county. On adoption the County Commissioners
are authorized (1) to include provisions and requirements in the code
reasonably designed to secure and preserve the public health, safety
and convenience; (2) to provide for the appointment and employment
of inspectors and other employees to enforce and administer the code,
and to provide penalties for a violation of the code; (3) to incorporate
therein by reference any code or portion thereof proposed by any
governmental agency or by any professional or trade association for
general distribution as a model or standard for a building code; but a
subsequent amendment to a change in any code so adopted in whole or
in part by reference is not incorporated into the building code of
Wicomico County until specifically considered and added by the
County Commissioners; (4) to provide that any code or codes so
adopted shall apply to certain designated and well defined areas of
Wicomico County or to all of said county; and (5) to provide that
the provision of any of said code or codes shall not be applicable to
any farm dwelling or any building or buildings deemed necessary
in the operation of any farm in said county.

Sec. 2. And be it further enacted, That this Act shall take effect
June 1, 1961.
