and the Board of County Commissioners of Worcester County have
requested that the State Roads Commission be authorized to conduct
certain engineering studies and make certain recommendations to
such Board of County Commissioners relating to the development of
the area, now therefor
Section 1. Be it enacted by the General Assembly of Maryland,
That the State Roads Commission is authorized to conduct engineer-
ing studies and surveys to determine proper sand dune elevations,
shore protection facilities, building set-back lines and restrictions,
type and method of soil stabilization of beach and dunes, the loca-
tions and method of erecting sand fences and such other things and
acts as may be necessary to protect the Ocean Highway between
Ocean City, Maryland, and the Delaware line from being damaged or
destroyed by flood waters.
Sec. 2. And be it further enacted by the General Assembly of
Maryland, That such Commission is authorized to use, in connection
with its studies and recommendations, personnel employed by such
Commission and retain the services of such independent engineers,
surveyors and others and do such other acts as it may deem necessary
to furnish the information and recommendations required.
Sec. 3. And be it further enacted by the General Assembly of
Maryland, That such Commission shall furnish the results of its
studies and its recommendations to the Board of County Commis-
sioners of Worcester County as they are completed and shall, from
time to time, furnish such additional information and recommenda-
tions as it deems appropriate or as requested by such Board of Coun-
ty Commissioners.
Sec. 4. And be it further enacted by the General Assembly of
Maryland, That the authority hereby conferred upon the State Roads
Commission shall continue for a two year period from the effective
date of this Act unless prior to that time the Board of County Com-
missioners of Worcester County shall have adopted zoning ordinances,
a building code and building set-back restrictions. In the event such
zoning and building regulations are established prior to such two
year period, the authority of the State Roads Commission thus con-
ferred shall cease.
Sec. 5. And be it further enacted by the General Assembly of
Maryland, That the Governor is hereby requested to include such sum
of money as he deems appropriate in the supplemental budget, which
money shall be used to reimburse the State Roads Commission for
its cost in conducting the engineering studies and preparing and pre-
senting the recommendations authorized by this Act.
SEC. 6. AND BE IT FURTHER ENACTED, THAT A NEW
SECTION 68A BE AND IT IS HEREBY ADDED TO ARTICLE
24 OF THE CODE OF PUBLIC LOCAL LAWS OF MARYLAND
(1930 EDITION), TITLE "WORCESTER COUNTY", SUB-TITLE
"COUNTY COMMISSIONERS", TO FOLLOW IMMEDIATELY
AFTER SECTION 68 THEREOF, TO READ AS FOLLOWS:
68A. THE COUNTY COMMISSIONERS OF WORCESTER
COUNTY MAY REIMBURSE THE STATE ROADS COMMIS-
SION IN A SUM NOT EXCEEDING ONE-THIRD OF THE COST
