has performed faithful service for not less than twenty years and
becomes permanently incapacitated for further duty as such member.
before attaining the age of sixty;
(c) Any member of the Anne Arundel County Police Force at his
request at any time after attaining the age of sixty FIFTY and before
attaining the age of sixty-five, if he has performed faithful service
therein for not less than twenty years;
(d) Any member of the Anne Arundel County Police Force on
attaining the age of sixty without any request on his part, WHO HAS
PERFORMED FAITHFUL SERVICE FOR NOT LESS THAN
TWENTY YEARS. No member of said Anne Arundel County Police
Force shall remain in service after he has attained the age of sixty five.
16-88. Any member of said Department retired under the pro-
visions OF SUB-SECTION (A) of Section 16-87 OR ANY WIDOW
OR CHILDREN OF A MEMBER WHO DIES AS A RESULT OF
ACCIDENT OR DISEASE INCURRED OR CONTRACTED WHILE
IN THE ACTUAL PERFORMANCE OF POLICE DUTY AND AS
A DIRECT AND NATURAL RESULT THEREOF shall receive an
annual pension equal to two-thirds of the highest annual compensation
received by him while holding the grade held by Mm at the time of
his retirement; provided however, that the monthly payments shall
not be less than $225.00 per month.
16-89. Any member of said Department retired under the pro-
visions of sub-sections (b), (c) or (d) of Section 16-87 shall receive
an annual pension equal to fifty percent of the highest annual com-
pensation received by him while holding the grade held by him at
the time of his retirement, if he has completed twenty years service;
an additional amount equal to two percent of said compensation for
each year of service after the first twenty years provided that the
total amount of said pension shall in no case exceed seventy percent
of said compensation.
16-40. The benefits provided in this article shall be due and payable
in the event of the death of a member, either before or after his
retirement as follows :
(a) To his widow, if any there be, until her death or remarriage.
(b) If there be no widow surviving, then to the child or children of
the deceased member until such child or children reach the age of
eighteen.
(c) If there be a widow surviving who shall remarry, then upon
such remarriage, to the child or children of the deceased member
until such child or children reach the age of eighteen years.
(d) (C) In the event a member or a widow of a member to whom a
pension allowance would be paid is appointed to any position in any
department of the county, the pension allowance shall be suspended
during the period of such employment.
Sec. 2. And be it further enacted, That this Act shall take effect
June 1, 1961.
