may, in its discretion, temporarily waive for a period of not exceeding
six months after June 1,1945, the requirement for an examination of
an applicant who on June 1, 1945, is actively engaged in the practice
of tree culture and care and has been so engaged for at least five years
next preceding said date.] A candidate who shall have passed a satis-
factory examination in all but one of the subjects given by the
Commission may be re-examined in that subject only, at subsequent
examinations held by the Commission, and if he passes in that subject
he shall be considered to have passed the examinations. Nothing in
this [subtitle] subheading shall be construed as prohibiting the re-
examination in all subjects of a candidate who has failed in a prior
examination.

405.

Every applicant shall pay to the Commission, at the time of mak-
ing his application, a fee of fifteen dollars ($15.00); in addition, any
applicant who fails to pass any examination, shall pay a fee of five
dollars ($5.00) for each re-examination or subsequent examination
given to him. Every person to whom a [certified] tree expert license
has been issued shall pay an annual renewal fee of five dollar DOL-
LARS ($5.00). From the fees collected under this [subtitle] subhead-
ing
the Commission shall pay all expenses of issuing licenses and
traveling expenses of its members in the performance of their duties
under this subheading, and if any surplus remains on the thirtieth day
of June of each year, this shall be paid into the treasury of the State,
for the use of the Department of Forests and Parks, to the extent that
such surplus exceeds one thousand dollars ($1,000.00) which will be
retained by the Commission of Forests and Parks as a working fund;
provided, that no expenses incurred under this [subtitle] subheading
shall be charged against the funds of the State of Maryland. The
Commission shall annually report to the Governor the number of
licenses issued and the receipts and expenses under this [subtitle]
subheading during each fiscal year.

The Commission of Forests and Parks, by majority vote thereof,
may permanently revoke or temporarily suspend any license of any
licensed [certified] tree expert who has been guilty of any fraud or
deceit in obtaining such license, or who has been guilty of negligence
or wrongful conduct in the practice of tree culture or care. The
Commission may promulgate, and may amend, from time to time,
rules of ethics and may temporarily suspend for a period not to ex-
ceed two years the license of any licensed [certified] tree expert who
violates such rules of ethics, this power of suspension being in addi-
tion to and not in limitation of the power to revoke or suspend
theretofore provided in this section. No license issued under this sub-
heading shall be revoked or the effect thereof suspended until the
holder shall have had a hearing before the Commission. Notice of
the cause for suspension or revocation under this section and the
date of hearing thereon by the Commission shall be mailed to the
holder of such [certificate] license at his or her last known address
at least twenty days before said hearing. The non-appearance of the
holder of such license after notice as herein provided shall not prevent
such hearing. By majority vote the Commission may reissue any
[certified] tree expert's license previously revoked. Any person not
a citizen of the United States when he or she recieves a license issued
