[A license shall be required of all persons who solicit, advertise or
otherwise engage in the tree culture practices enumerated above.]

402.

The Commission of Forests and Parks, or its duly authorized
agent, is hereby authorized to examine applicants for license as
[certified] tree experts and to pass upon their competency as such.
The Director as administrative head of the Department of Forests
and Parks shall be deemed to be the duly authorized agent of the
Commission of Forests and Parks.

403. The Commission of Forests and Parks shall issue and grant a
[certified] "tree expert" license to any applicant, who, in the opinion
of the Commission, has qualified by the following:

(1)   Who pays the fees hereinafter provided;

(2)    Who is a citizen of the United States or who has duly de-
clared his or her intention of becoming such citizen;

(3)   Who is over the age of twenty-one years;

(4)   Who is of good moral character;

(5)  (a) Who has had four years of approved college education, pref-
erably in forestry, landscaping or agriculture, or the equivalent; or

(b)   Who, in the opinion of the Commission has had sufficient
professional experience in tree care to justify waiver of the require-
ment of four years of college or an equivalent education; or

(c)   Who shall have continuously for at least five years immediately
preceding the date of his application been engaged in practice as a
tree expert; [or]

(6)   Who shall have successfully passed such examinations, as
may be given by the Commission as hereafter provided.

(7)    All licensees shall show proof of and carry liability and prop-
erty damage insurance, in such form and amounts as may from time
to time be required in the discretion of the Commission,
at the time of
issuing of said license and shall maintain said insurance protection
for the period the license is in effect.

The Commission shall issue, without examination, a license to all
persons applying therefor who, as of May 31, 1961, were holders in
good standing of a "Certified tree expert license" under the former
repealed Maryland law; however, immediately upon such issuance
all such new licenses shall be held subject to all of the provisions
hereof.

404.

The Commission shall prepare all examinations hereinabove pro-
vided for, and shall conduct the same as often as it deems necessary,
but at least once each year [,] if there are any applicants. [Every
applicant who has never been licensed under this subheading or who
has not been the holder of an operative license for three years next
preceding the date of application, must take and pass the examina-
tions prescribed by the Commission; provided that the Commission
